Recommendation
Approve Amendment No. 1 to Revenue Agreement No. 17-94 with OneLegacy to perform tissue and organ procurement services at the San Bernardino County Coroner’s morgue facility, increasing the annual compensation by $12,000, from $60,000 to an amount no less than $72,000, and extending the original term by three months for a new Agreement term of April 1, 2017 through June 30, 2022.

FINANCIAL IMPACT
Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost). The Sheriff/Coroner/Public Administrator (Department) will receive at least $12,000 during the extended term of the Agreement to reimburse the Department for all costs associated with the use of the Department’s facility by OneLegacy for tissue and organ procurement services, including any overtime, call-back and on-call costs incurred by Department staff (including any administrative overhead) during the performance of services by OneLegacy. Sufficient appropriation and revenue have been included in the Department’s 2021-22 budget.
BACKGROUND INFORMATION
Organ and tissue procurement agencies have been established to promote and facilitate donation of organs and tissues in a manner beneficial to donor’s families, donor recipients, healthcare providers and the public. The Coroner’s office has had an association with multiple organ and tissue procurement agencies for the past 38 years.
In 1984, the United States Congress passed the National Organ Transplant Act (NOTA), allowing the Department of Health & Human Services to establish the Organ Procurement and Transplantation Network (OPTN), which is a public-private partnership that links all professionals involved in the country’s organ donation and transplantation system. The OPTN is designed to make available more life-saving organs for transplant. The OPTN has identified four Organ Procurement Organizations (OPOs) in the State of California, each with its own designated Donation Service Area (DSA). OneLegacy’s DSA includes the following counties: Kern, Los Angeles, Orange, Riverside, San Bernardino, Santa Barbara and Ventura. OneLegacy is the only designated OPO for San Bernardino County, with headquarters in Los Angeles and a local office in Redlands.
On February 14, 2017 (Item No. 70), the Board of Supervisors approved Agreement No. 17-94 with OneLegacy that allowed for organ and tissue procurement from April 1, 2017 through March 31, 2022. Approval of this item will allow for the continuation of tissue and organ recovery from decedents within the County’s jurisdiction upon consent of the next of kin for the purpose of transplantation to donor recipients, while negotiations for a new contract are completed. Additionally, approval of the extension to Agreement No. 17-94 by three months over the County’s standard maximum contract term of five years is an exception to County Policy 11-06, Standard Practice 1.
The contract provides for onsite tissue procurement services by OneLegacy, and includes a provision to terminate the agreement upon 60-days advance written notice by either party.
