Recommendation

Acting as the governing body of the San Bernardino County Fire Protection District, approve Amendment No. 5, retroactively effective July 1, 2024, to Revenue Agreement No. 19-545 with the San Bernardino International Airport Authority for aircraft rescue/firefighting services and other fire protection services at the San Bernardino International Airport, increasing the annual contract amount by $171,626, from $1,153,406 to $1,325,032, for 2024-25 with no change to the contract period of August 1, 2018, through June 30, 2026.

FINANCIAL IMPACT

Approval of this amendment will not result in the use of Discretionary General Funding (Net County Cost) as this is a revenue contract. The San Bernardino International Airport Authority (SBIAA) is compensating San Bernardino County Fire Protection District (SBCFPD) for the cost of providing service in accordance with the terms of Agreement No. 19-545 (Agreement).  The increase in annual compensation to SBCFPD from this amendment is $171,626, for total revenue in 2024-25 of $1,325,032.  Revenue and appropriation related to this Agreement is included in SBCFPD’s 2024-25 budget and will be included in future recommended budgets as appropriate.     

 

BACKGROUND INFORMATION

On August 6, 2019 (Item No. 49), the Board of Directors (Board) approved the Agreement allowing SBCFPD to receive annual compensation of $775,254 for providing aircraft rescue/firefighting services and other fire protection services, including but not limited to, fire investigation, advanced life support, fire prevention, fire inspection, permit assistance, and air show and event support at the San Bernardino International Airport (Airport) through June 30, 2023.  The Agreement also allows SBCFPD to lease a building at the Airport in the amount of $1 per year for use as a fire station, as well as utilize SBIAA-owned apparatus/equipment for fire station operations. 

 

The compensation amount for providing these services is adjusted annually based on various factors, including increased salary and benefit expenses resulting from negotiated Memoranda of Understanding (MOUs) with the labor unions and increases in supplies based on changes to the Consumer Price Index, and are in accordance with Section 7(c) of the Agreement.  To date, the Agreement has been amended four times as follows:

                     Amendment No. 1, approved by the Board on July 14, 2020 (Item No. 57), increased SBCFPD’s annual compensation by $84,243 to a total of $859,497 for 2020-21.

                     Amendment No. 2, approved by the Board on June 22, 2021 (Item No. 115), increased SBCFPD’s annual compensation by $111,079 to a total of $970,576 for 2021-22.

                     Amendment No. 3, approved by the Board on May 23, 2023 (Item No. 96), increased SBCFPD’s annual compensation by $109,943 to a total of $1,080,519 for 2022-23.

                     Amendment No. 4, approved by the Board on October 3, 2023 (Item No. 66), increased SBCFPD’s annual compensation by $72,887 to a total of $1,153,406 for 2023-24, as well as extended the term of the Agreement by three years, for a total contract period of August 1, 2018, through June 30, 2026.

 

Approval of Amendment No. 5 will increase the Agreement’s annual compensation amount by $171,626, from $1,153,406 to $1,325,032, for SBCFPD’s additional costs of providing service to the SBIAA.  The additional costs primarily represent increased salary and benefit expenses resulting from negotiated MOUs with the labor unions.  Amendment No. 5 is retroactive to July 1, 2024, due to a delay in contract negotiations and subsequent time required for fiscal and legal reviews.  The signed Amendment was received on June 26, 2025, and is presented at this time as this is the first available Board meeting.  All other terms of the Agreement shall remain the same.
