RECOMMENDATION(S)
Recommendation
1. Authorize the transfer of 34 positions from the Probation Department to the Department of Behavioral Health, as detailed in Attachment A.
2. Authorize the Auditor-Controller/Treasurer/Tax Collector to post the necessary 2024-25 budget adjustments as indicated in the Financial Impact section (Four votes required).
3. Authorize the Human Resources Department to transfer incumbents in filled positions from the Probation Department to the Department of Behavioral Health.

Approval of this item does not impact Discretionary General Funding (Net County Cost). These positions will continue to be funded through the Juvenile Justice Realignment Block Grant (JJRGB) through a Memorandum of Understanding between Probation Department (Probation) and the Department of Behavioral Health (DBH).

BACKGROUND INFORMATION
On September 30, 2020, Governor Gavin Newsom signed Senate Bill 823 (SB 823) into law (Chapter 337, Statutes of 2020), transferring responsibility for managing all youth offenders from the State of California Department of Corrections and Rehabilitation Division of Juvenile Justice (DJJ) to individual counties effective July 1, 2021. SB 823 established the JJRBG program to provide county-based custody, care, and supervision of youth who would have been committed to DJJ custody. As a result, the County’s youth are sent to Probation’s secured youth treatment facility (SYTF) where the County assumes responsibility for the care, custody, and supervision of these youth.
Probation has 34 mental health clinical positions, identified in Attachment A, which staff the SYTF and provide mental health services to incarcerated youth. All the positions are supervised by a Mental Health Program Manager I or a Mental Health Program Manager II from DBH.
Since the 34 mental health clinical positions are supervised by DBH staff, Probation recommends transferring the positions from Probation to DBH to improve the recruitment and hiring process and to provide the appropriate operational oversight to these positions. Upon approval of the transfer, DBH will have full responsibility for recruitment, training, placement and work performance evaluation.
