Approve Amendment No. 1 to Revenue Agreement No. 19-238 with OneLegacy for reimbursement of organ, tissue, and eye procurement services, extending the term by one-year for a total contract term of July 1, 2019 through June 30, 2025.

FINANCIAL IMPACT

Approval of the item will not result in the use of Discretionary General Funding (Net County Cost). Under the terms of Revenue Agreement No. 19-238 (Revenue Agreement), OneLegacy will reimburse designated amounts for specific hospital services including donor evaluation and diagnostics, donor treatment, and nursing care. The reimbursement varies depending upon the services required and number of donors. Adequate appropriation and revenue have been included in the Arrowhead Regional Medical Center (ARMC) 2023-24 budget and are included in the 2024-25 recommended budget.

 

BACKGROUND INFORMATION

Approval of Amendment No. 1 (Amendment) to the Revenue Agreement will allow ARMC to remain in compliance with state and federal requirements by continuing services with OneLegacy, the designated organ, tissue and eye procurement agency, in accordance with California Health and Safety Code Section 7150.5 et seq. or successor statutes, henceforth referred to as the Uniform Anatomical Gift Act, and federal law and regulations, including 42 C.F.R Section 482.45 et seq., also referred to as the "Medicare Conditions of Participation". OneLegacy is designated by the Federal Secretary of Health and Human Services as the only approved organ procurement organization in San Bernardino County. A one-year extension of the current Revenue Agreement is necessary as both parties continue to negotiate in good faith to enter into a new five-year agreement.

 

The Federal Secretary of Health and Human Services is responsible for designating which organ procurement agency hospitals may use for organ procurement services; and OneLegacy has been the organ procurement agency for San Bernardino County for more than 25 years. In addition to San Bernardino County, OneLegacy provides organ and tissue services to Los Angeles, Kern, Orange, Santa Barbara, Ventura, and Riverside counties. They are the largest national organization of this type and are available 24 hours a day to assist in the evaluation of donors and recipients.

 

 

On April 30, 2019 (Item No. 11), the Board of Supervisors approved the Revenue Agreement with OneLegacy for reimbursement of organ and tissue procurement services by ARMC for the period of July 1, 2019 through June 30, 2024.

 

ARMC recommends approval of the Amendment, as ARMC and OneLegacy are mutually dedicated to the increased availability of organs, tissue, and eyes for transplantation necessary for patients and research. Organ procurement organizations, such as OneLegacy, assist in providing for the safety, health and social service needs of County residents by helping hospitals promote and facilitate the donation of organs in a manner beneficial to patients, donors’ families, healthcare providers, and the public.
