RECOMMENDATION(S)
Recommendation
1. Approve Agreement with the State of California Department of California Highway Patrol to provide uniformed personnel with patrol vehicles for traffic control and enforcement related services throughout San Bernardino County unincorporated areas on an as-needed basis, for a total not-to-exceed amount of $180,000 retroactively effective March 1, 2023 through February 28, 2025.
2. Authorize the Director of the Department of Public Works to sign and submit the Agreement to the State of California Department of California Highway Patrol for traffic control and enforcement related services in San Bernardino County unincorporated areas on an as-needed basis.
3. Direct the Director of the Department of Public Works to transmit the fully executed Agreement to the Clerk of the Board of Supervisors within 30 days of execution.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The Department of Public Works (Department) shall reimburse the State of California Department of California Highway Patrol (CHP) in an amount not-to-exceed $180,000, for increased traffic control and enforcement services in San Bernardino County (County) unincorporated areas. Reimbursement shall be funded with Gas Tax revenue administered by the Department. Sufficient appropriation and revenue are included in the Department’s 2023-24 Road Operations Budget (6650002000 02H15080, 02H15197) and will be included in future recommended budgets.
BACKGROUND INFORMATION
On October 6, 2020 (Item No. 30), the Board of Supervisors (Board) approved and authorized the Director of the Department of Public Works to sign and submit the Reimbursement Letter of Agreement between the CHP and the Department (CHP Agreement No. 20R850000) for the CHP to provide uniformed personnel with patrol vehicles for traffic control throughout the unincorporated areas of the County to make motorists aware of the speed of which they travel and adhere to the posted speed limits. This Reimbursement Letter of Agreement was approved for the period of October 6, 2020 through October 5, 2022, in a not-to-exceed amount of $45,000.
On July 27, 2023, the CHP provided the County a Standard Agreement (Agreement) for the term of March 1, 2023 through February 28, 2025, for a not-to-exceed amount of $180,000, to provide traffic patrol and enforcement related services, as the previously Board approved Reimbursement Letter of Agreement was a short-term agreement for reimbursement not to exceed a total of $50,000. This Agreement is retroactively effective due to a delay in the CHP’s Agreement approval process. No services were requested from the CHP by the Department between expiration of the previous agreement and the start date of this Agreement, March 1, 2023. However, in good faith, the CHP agreed to render services requested by the Department between March 1, 2023, and the date on which this Agreement is approved but will not bill the Department for such services as the CHP cannot bill without a fully executed Agreement. The Department requested services provided by the CHP in June 2023, for which CHP will bill the Department once the Agreement is approved.
Approval of this Agreement will allow the CHP to continue providing uniformed personnel with patrol vehicles for traffic control throughout the County unincorporated areas for the period of March 1, 2023 through February 28, 2025. This Agreement will also add enforcement services to the scope of work that can be requested from the CHP, by the Department.
Due to increased traffic and the number of Department road construction projects, the Department finds it necessary to utilize the CHP traffic control and enforcement services throughout the County’s unincorporated areas to ensure the safety of motorists and Department staff during road construction projects.
The Agreement may be cancelled by either party with 30 days advance written notice or by either party without prior notice in the event of an emergency.
Approval of this item aligns with the County and the Chief Executive Officer’s goals of providing for the safety, health, and social services needs of County residents and by working with other agencies to immediately utilize traffic control and enforcement services on County roads.
