RECOMMENDATION(S)

Recommendation

1.                     Approve non-financial Data Use and Disclosure Agreement with the California Department of Public Health, Division of Communicable Disease Control, that defines information privacy and security requirements with respect to all data collected or created in the California Reportable Disease Information Exchange system by San Bernardino County, effective for a period of three years from execution by all parties.

2.                     Authorize the Director of the Department of Public Health to execute the Data Use and Disclosure Agreement, as required by the California Department of Public Health, Division of Communicable Disease Control, and any subsequent non-substantive amendments and documents, on behalf of the County, subject to review by County Counsel.

3.                     Direct the Director of the Department of Public Health to transmit the Data Use and Disclosure Agreement and any non-substantive amendments to the Clerk of the Board of Supervisors within 30 days of execution.

FINANCIAL IMPACT

The recommended Data Use and Disclosure Agreement (Agreement) is non-financial in nature and as such, does not impact Discretionary General Funding (Net County Cost).

 

BACKGROUND INFORMATION

The recommended non-financial Agreement with the California Department of Public Health, Division of Communicable Disease Control (State) will provide the Department of Public Health (DPH) with access to the California Reportable Disease Information Exchange (CalREDIE) system. The CalREDIE system, the State’s communicable disease reporting and surveillance system of record, is utilized by state and local public health officials and healthcare providers for communicable disease reporting and surveillance. The Agreement outlines requirements between the State and the County in order to protect the privacy and provide for the security of all CalREDIE Data, in compliance with all state and federal laws applicable to the CalREDIE Data. 

 

CalREDIE Data refers to data in the state-wide reportable disease database that is supported and maintained by the State including demographic and epidemiologic statistics. The data collected includes information contained in, or derived from, confidential morbidity reports, laboratory test results, and administrative information on reportable diseases collected for the purposes of case investigation, disease prevention, and surveillance.

 

A Data Use and Disclosure Agreement between the State and DPH for use of the CalREDIE system has been in effect since 2018, with the most recent agreement approved by the Board of Supervisors on August 24, 2021 (Item No. 32), which was effective for three years following execution by the State. The proposed Agreement, which was provided to DPH by the State on August 13, 2024, allows DPH to continue to use the CalREDIE system for collection of communicable disease and surveillance data. The administrative information collected on reportable diseases is utilized to combat health outbreaks of viruses and diseases throughout the county.
