RECOMMENDATION(S)
Recommendation
1. Acting as the governing body of San Bernardino County:
a. Accept Grant (Grant Award No. 2022-0043) in the amount of $2,161,778 from the California Governor’s Office of Emergency Services for the Fiscal Year 2022 Homeland Security Grant Program, of which San Bernardino County will retain $1,272,720 and the remaining $889,058 will be distributed to various grant subrecipients, to continue San Bernardino County’s efforts in preventing, preparing for, protecting against, responding to, and recovering from acts of terrorism, with a grant performance period of September 1, 2022 through May 31, 2025.
b. Approve the Subrecipient Assurances template to be entered into between San Bernardino County and all grant subrecipients for Grant Award No. 2022-0043.
c. Authorize the Deputy Executive Officer to sign Subrecipient Assurances with all grant subrecipients and any other documents necessary to secure Grant Award No. 2022-0043.
2. Acting as the governing body of the Inland Counties Emergency Medical Agency:
a. Accept subrecipient grant award in the amount of $16,531, which is part of the $2,161,778 Grant Award No. 2022-0043 received by San Bernardino County from the California Governor’s Office of Emergency Services for the Fiscal Year 2022 Homeland Security Grant Program, to continue the Inland Counties Emergency Medical Agency’s efforts in preventing, preparing for, protecting against, responding to, and recovering from acts of terrorism, with a grant performance period of September 1, 2022 through May 31, 2025.
b. Approve the Subrecipient Assurances with San Bernardino County for Grant Award No. 2022-0043.
c. Adopt Proof of Authority, as required by the Subrecipient Assurances with San Bernardino County for Grant Award No. 2022-0043, in which the Board of Directors, on behalf of the Inland Counties Emergency Medical Agency, agrees to the following:
i. Any liability arising out of the performance of the Subrecipient Assurances shall be the responsibility of the Inland Counties Emergency Medical Agency and the Board of Directors.
ii. Grant funds shall not be used to supplant expenditures controlled by the Board of Directors.
iii. The Inland Counties Emergency Medical Agency is authorized by the Board of Directors to apply for federal assistance, and the institutional, managerial, and financial capability (including funds sufficient to pay the non-federal share of project cost, if any) to ensure proper planning, management and completion of the project described in the Subrecipient Assurances.
iv. The official executing the Subrecipient Assurances is, in fact, authorized to do so.
d. Authorize the Emergency Medical Services Administrator to sign the Subrecipient Assurances with San Bernardino County and any other documents necessary to secure subrecipient Grant Award No. 2022-0043.
e. Direct the Emergency Medical Services Administrator to transmit the fully executed Subrecipient Assurances to the Secretary of the Board of Directors within 30 days of execution.
3. Acting as the governing body of San Bernardino County Fire Protection District:
a. Accept subrecipient grant award in the amount of $200,188, which is part of the $2,161,778 Grant Award No. 2022-0043 received by San Bernardino County from the California Governor’s Office of Emergency Services for the Fiscal Year 2022 Homeland Security Grant Program, to continue San Bernardino County Fire Protection District’s efforts in preventing, preparing for, protecting against, responding to, and recovering from acts of terrorism, with a grant performance period of September 1, 2022 through May 31, 2025.
b. Approve Subrecipient Assurances with San Bernardino County for Grant Award No. 2022-0043.

Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost). Of the $2,161,778 awarded to San Bernardino County, various County departments will receive $1,272,720, and the remaining $889,058 will be distributed to grant subrecipients as reflected in the following table:

BACKGROUND INFORMATION
The San Bernardino County Operational Area (OA) was established to manage and coordinate emergency preparedness efforts among San Bernardino County’s (County) 24 cities and towns, Board and self-governed special districts, state/federal agencies, and others. In 1995, the County’s Office of Emergency Services (OES) was designated as the lead agency for the OA through approval of Agreement No. 95-840.The OA has annually received Homeland Security Grant Program (HSGP) funds to strengthen the region’s homeland security preparedness in relation to terrorism since the onset of the program. The OA is responsible for allocating these funds to County departments, cities/towns, fire agencies, police departments, CONFIRE, San Bernardino County Fire Protection District (SBCFPD), and the Inland Counties Emergency Medical Agency (ICEMA).
Proposed projects for Fiscal Year (FY) 2022 HSGP funding were collected by OES from participating OA jurisdictions. On February 2, 2022, the OA’S Approval Authority, which consists of the County Public Health Officer, SBCFPD Fire Chief/Fire Warden, a Municipal Fire Chief selected by the OA Fire Chiefs, County Sheriff-Coroner, and a Chief of Police selected by the OA Police Chiefs, met and voted to approve a list of projects for submittal, as is required in the California Governor’s Office of Emergency Services (Cal OES) California State Supplement to the Federal Notice of Funding Opportunity, which states that OA’s must appoint these representatives to have “final approval of the OA’s application for HSGP funds.”
On December 13, 2022 (Item No. 36), the Board authorized submittal of a grant application to the Cal OES for the FY 2022 HSGP. The application requested grant funding in the amount of $2,161,778 for various projects, as approved by the OA’s Approval Authority, to continue the County’s efforts in preventing, preparing for, protecting against, responding to, and recovering from acts of terrorism.
On September 7, 2023, OES received notification from Cal OES that the FY 2022 HSGP application was approved in the requested amount of $2,161,778. Pursuant to County Policy 05-13, Board approval is needed to accept the grant award. The performance period of this grant is retroactive to September 1, 2022 through May 31, 2025. Because the application submission deadline was after the performance period start day, this grant is consistently retroactive. County OES applied for the grant on January 12, 2023.
