Approve Program Supplement Agreement No. F162 to Master Agreement No. 08-5954F15 with the State of California Department of Transportation, to provide $2,560,000 in federal Community Project Funding/Congressionally Directed Spending funds toward the $4,012,179 costs for the Construction phase of the Little Third Street and Little Tippecanoe Avenue Improvement Project.

FINANCIAL IMPACT

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The total estimated cost to construct roadway improvements on Little Third Street, from Palm Lane east to Little Tippecanoe Avenue as well as along Little Tippecanoe Avenue, from Little Third Street north to Tippecanoe Avenue (Project) in the San Bernardino area is $4,012,179. The Project will be funded with $2,560,000 from federal Community Project Funding/Congressionally Directed Spending (CPFCDS) funds allocated by Congress and administered by the California Department of Transportation (Caltrans), and the local match of $1,452,179 from Measure “I” Local Streets Program - San Bernardino Valley Subarea funds. Sufficient appropriation and revenue are included in the Department of Public Works (Department) 2024-25 Road Operations Budget (6650002000 H15122) and will be included in future recommended budgets, as needed.

 

BACKGROUND INFORMATION

The Project consists of pavement rehabilitation, new asphalt concrete pavement, sidewalks, curb and gutter, storm drains, fencing, streetlights, and installing new and replacing curb ramps in accordance with current design standards and pursuant to the Americans with Disabilities Act guidelines. The Project was selected by the Department to solicit federal earmark requests after passage of the federal Infrastructure Investment and Jobs Act (IIJA) was signed into law in November 2021. The law established the CPFCDS program, which allows members of Congress to nominate specific community projects as part of the annual appropriations process. Congressman Pete Aguilar, representing California District 33, requested $2,560,000 in CPFCDS funds to construct the Project. The request was approved with funding included in the federal Consolidated Appropriations Act of 2023.

 

On August 20, 2024 (Item No. 67), the Board of Supervisors approved prioritization of this Project as part of the Measure “I” Local Street Pass Through Funds Five-Year Capital Improvement Plan Project List and the Expenditure Strategy for 2024-25 through 2028-29.

 

In accordance with Agreement No. 16-578 (Master Agreement No. 08-5954F15), approved by the Board of Supervisors on July 26, 2016 (Item No. 29), approval of a Program Supplement Agreement is required for each specific Project and prior to the County invoicing for reimbursement of costs associated with the Project. The Program Supplement Agreement establishes special covenants as a condition for the local agency to receive federal aid through the State for a designated project. The Program Supplement Agreement also identifies the type of funds available for reimbursement.

 

The Project meets the County and the Chief Executive Officer’s goals and objectives by securing funding for the Project to preserve and improve existing County roadways for the safety of the public.
