Recommendation
Approve Amendment No. 1 to Agreement No. 23-343 with Alcon Vision, LLC for the consignment of Clareon Intraocular Lens surgical delivery system to extend the term of the contract by four years, for a total contract term of May 23, 2023 through May 22, 2028, with no change to the not-to-exceed contract amount of $80,000.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The cost of $80,000 is funded by State Medi-Cal, Federal Medicare, private insurances, and other departmental revenue. Funding sources may change in the future pending any legislative activity related to the repeal and/or replacement of the Affordable Care Act. Adequate appropriation and revenue have been included in the Arrowhead Regional Medical Center (ARMC) 2023-24 budget and will be included in future recommended budgets.
BACKGROUND INFORMATION
The Amendment to Agreement No. 23-243 (Agreement) with Alcon Vision, LLC (Alcon), will allow ARMC to continue to obtain the Clareon Intraocular Lens (IOL) for cataract surgeries performed at ARMC through consignment. The Clareon IOL is an automated, disposable, pre-loaded IOL delivery system that enables the precise delivery of the IOL in patients undergoing cataract surgery.
The IOL is specifically made for, and can only be used on, the Alcon equipment that is used at ARMC. It is necessary to keep an inventory of IOL on hand so that the ophthalmologic surgeon has the ability to utilize the most clinically accurate lens for the best possible outcome of each patient. The IOLs are provided on consignment, and Alcon will supply the IOL to ARMC to keep on hand for future use. As ARMC is only invoiced when the Alcon equipment is used, no additional funds are required for the extension of this Agreement.
On May 23, 2023 (Item No. 12), the Board of Supervisors (Board) approved the Agreement with Alcon, including non-standard terms, for the Clareon IOL surgical delivery system, in the amount not to exceed $80,000 for the one-year term of May 23, 2023 through May 22, 2024.
ARMC recommends approval of the Amendment to the Agreement with Alcon to provide for patient safety and health needs by supplying the Clareon IOL delivery system for ARMC surgeons to perform cataract surgeries.
PROCUREMENT
On May 23, 2023 (Item No. 12), this item was submitted to the Board erroneously as a non-competitive procurement for time constraints to allow time for a Request for Proposal to be completed; however, the IOL is non-competitive based on system compatibility because the IOL is specifically made for and can only be used on the Alcon equipment that is used at ARMC. The Purchasing Department continues to support this non-competitive procurement based on system compatibility.
