RECOMMENDATION(S)

Recommendation

1.                     Acting as the governing body of the County of San Bernardino:

a.                     Rescind the previously Board of Supervisors approved Item No. 104 on May 19, 2020, pertaining to the Public Authority/Non-Profit Consortium Rate Change Request.

b.                     Approve and authorize the submission of a Public Authority/Non-Profit Consortium Rate Change Request (SOC 449) to the California Health and Human Services Agency, Department of Social Services, effective July 1, 2020, updating the Rate Table pertaining to the In-Home Supportive Services provider wage, per the terms of the In-Home Supportive Services Provider Unit Memorandum of Understanding, for a total increase of $0.34 per hour, from $14.62 per hour to $14.96 per hour, effective upon approval by the California Department of Social Services, as specified below:

i.                     Wage Supplement (one-time) increase of $0.25 per hour, from $13.25 per hour to $13.50 per hour.

ii.                     Payroll Tax rate increase of $0.02 per hour, from $1.18 per hour to $1.20 per hour.

iii.                     Administrative Rate increase of $0.07 per hour, from $0.06 per hour to $013 per hour.

2.                     Acting as the governing body of the In-Home Supportive Services Public Authority:

a.                     Rescind the previously Board of Directors approved Item No. 104 on May 19, 2020, pertaining to the Public Authority/Non-Profit Consortium Rate Change Request.

b.                     Adopt a Resolution approving the In-Home Supportive Services provider wage rate change as specified on the Public Authority/Non-Profit Consortium Rate Change Request (SOC 449) and authorize the Chairman and the Vice Chair of the Board of Supervisors to sign the Resolution, as required by the California Department of Social Services.

FINANCIAL IMPACT

This item does not impact Discretionary General Funding (Net County Cost).  The net rate increase of $0.34 per hour to the Public Authority/Non-Profit Consortium rate will be funded by federal, state funds, and Social Services Realignment.   The estimated total hourly rate of $14.96 is computed by adding total services costs and total administrative costs divided by the number of estimated IHSS provide hours.  Adequate appropriation and revenue been included in the IHSS Public Authority 2020-21 budget and in future recommended budgets. 

 

BACKGROUND INFORMATION

In 2002, the County established the IHSS Public Authority to serve elderly, blind, or disabled individuals who are not able to remain in their homes without assistance.  Ordinance No. 3842 (adopted on January 8, 2002, Item No. 58) established the IHSS Public Authority to act as the employer for San Bernardino IHSS providers pursuant to Welfare and Institutions Code section 12301.6, subdivision (c)(1), and to perform other IHSS functions as required by Welfare and Institutions Code section 12301.6, subdivision (e) and not retained by the County.

 

On December 10, 2019 (Item No. 50), the Board of Supervisors approved the Memorandum of Understanding (MOU) with the Service Employees International Union Local 2015, who represent the providers in the IHSS Provider Unit, through January 31, 2023.  Under the terms of the MOU, a wage supplement of $0.25 is to be provided to IHSS providers effective July 1, 2020, upon approval by the California Department of Social Services (CDSS) through the submission of the Public Authority/Non-Profit Consortium Rate Change Request (SOC 449).  

 

On May 19, 2020, Item No. 104 was approved by the governing bodies of the IHSS Public Authority, the Board of Supervisors and the Board of Directors (Boards), approving and authorizing the submission of a Public Authority/Non-Profit Consortium Rate Change Request (SOC 449) to the California Health and Human Services Agency, Department of Social Services, to be effective July 1, 2020.  In addition, this item adopted Resolution No. 2020-67 approving the IHSS provider wage rate change as specified on the Public Authority/Non-Profit Consortium Rate Change Request (SOC 449) and authorized the Chairman and the Vice Chair of the Board of Supervisors to sign the Resolution, as required by CDSS.

                     

After submission by IHSS Public Authority of the required documents to CDSS (Agenda Item, Resolution, and SOC 449 form), it was discovered that the Agenda Item and Resolution contained a clerical error in the Payroll Tax hourly rates.  The increase of $0.02 per hour to the Payroll Tax is correct; however, the beginning and new rate was inadvertently indicated as $1.16 per hour to $1.18 per hour, instead of the updated and correct $1.18 per hour to $1.20 per hour.  Due to this oversight, IHSS Public Authority is requesting to rescind Item No. 104 approved on May 19, 2020, and authorize the submission of a new Resolution with the correct information to CDSS, required to be included with the Public Authority/Non-Profit Consortium Rate Change Request (SOC 449), effective July 1, 2020.  

 

 

Approval of this item by the governing Boards at this time will not impact IHSS Public Authority’s activities as CDSS has received the Public Authority/Non-Profit Consortium Rate Change Request (SOC 449) reflecting the accurate information and has granted approval for IHSS Public Authority to provide a corrected Resolution upon approval at the next available Board meeting.
