RECOMMENDATION(S)

Recommendation

Ratify the Chief Executive Officer’s exercise of the authority granted by the Board of Supervisors on March 1, 2023 (Item No. 1), in approving the following contracts for emergency snow removal services necessary to provide assistance to ensure the health and welfare of the residents of the impacted areas during the local emergency:

1.                     Contract with Blueberry Rentals, executed on March 16, 2022, in a not-to-exceed amount of $200,000, for the contract term of March 7, 2023, through April 11, 2023.

2.                     Contract with GRB Equipment Rental, Inc., executed on March 16, 2022, in a not-to-exceed amount of $200,000, for the contract term of March 7, 2023, through April 11, 2023.

3.                     Contract with Rykstone Construction, LLC, executed on March 9, 2022, in a not-to-exceed amount of $200,000, for the contract term of March 9, 2023, through March 23, 2023.

FINANCIAL IMPACT

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost).  The Department of Public Works - Transportation (Department) is financed by Gas Tax revenues, fee revenue, and other local, state, and federal funding.  Due to the emergency declaration by the State and Federal government, the Department will be seeking reimbursement from the California Office of Emergency Services and Federal Emergency Management Agency, as applicable.  Sufficient appropriation and revenue have been included in the Department’s 2022-23 budget.

 

BACKGROUND INFORMATION

On February 22, 2023, the start of an extreme weather event impacted various portions of the County. This event produced conditions of peril to the safety of person and property within the County. On February 27, 2023, the Chief Executive Officer (CEO), while serving as the Director of Emergency Services, proclaimed the existence of a local emergency on February 27, 2023. On February 28, 2023 (Item No. 81), the Board of Supervisors (Board) ratified the action of the Director of Emergency Services in proclaiming the existence of a local emergency as a result of the extreme weather event and continued the local emergency for an additional period in accordance with Government Code section 8630(c).

 

In further response to the ongoing local emergency, on March 1, 2023 (Item No. 1), the Board approved delegated authority to the Chair, CEO, County Chief Financial Officer, and, Fire Chief to approve any and all contracts or agreements, including contracts with non-standard language as identified in County Policy 11-05, Section B, necessary to provide any and all assistance necessary to ensure the health and welfare of the residents of the impacted areas during the emergency, as well as the provision of County resources, services and expenditures to ensure the public and first responders have access to necessary infrastructure such as grocery stores, gas stations, utilities and public infrastructure. 

 

The Department utilized various existing Board approved on-call vendors in response to the extreme weather event and resulting local emergency.  However, additional equipment and resources were needed to ensure the health and welfare of the residents of the impacted areas during the emergency.  Accordingly, pursuant to the delegated authority provided by the Board on March 1, 2023 (Item No. 1), the contracts referenced in Recommendation Nos. 1 through 3 for emergency snow removal services were approved and executed by the CEO, as these contractors could rapidly respond and provide additional services necessary in the affected areas.

 

The contracts executed by the CEO, pursuant to the Board’s delegated authority, are required to be brought back to the Board for ratification within 30 days of execution.
