RECOMMENDATION(S)

Recommendation

Acting as the governing body of the San Bernardino County Flood Control District:

1.                     Find that approval of Amendment No. 2 to License Agreement No. 10-752 with City of Loma Linda, for the non-exclusive use of Flood Control District land, is an exempt project under the California Environmental Quality Act Guidelines, Section 15301 - Existing Facilities (Class 1).

2.                     Approve Amendment No. 2 to License Agreement No. 10-752 with City of Loma Linda, as follows:

a.                     Approve the continued non-exclusive use of Flood Control District land by the City of Loma Linda, consisting of approximately 3,450 square feet of land running parallel to the Flood Control District right-of-way at San Timoteo Creek, south of Redlands Boulevard and west of Anderson Street (Assessor’s Parcel Number: 0283-062-30-0000).

b.                     Approve the exercise of the second of four five-year options, extending the license term from February 16, 2026 through February 15, 2031.

c.                     Approve an increase to the total contract amount by $6,740, increasing the total contract value from $15,220 to $21,960 over the amendment term.

3.                     Direct the Real Estate Services Department to file the Notice of Exemption in accordance with the California Environmental Quality Act.

FINANCIAL IMPACT

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost).  Total revenue for Amendment No. 2 (Amendment) to License Agreement No. 10-752 (License) over the five-year amendment term is $6,740.  Revenue will be deposited in the County Flood Control District (FCD) Zone 3 fund (1930002526).  Annual revenue is as follows:

BACKGROUND INFORMATION

On July 27, 2010 (Item No. 81), the Board of Supervisors (Board) approved the License with the City of Loma Linda for an initial 10-year term with four optional 5-year extensions.  In the 15 years since the License was originally approved, the Board has approved one amendment on February 9, 2021 (Item No. 72) to exercise the first option for five years from February 16, 2021 through February 15, 2026.  All other License terms remain unchanged.

 

On July 15, 2025, the Real Estate Services Department (RESD) initiated negotiations for Amendment No. 2, covering the next five-year term from February 16, 2026 through February 15, 2031.  This Amendment allows for continued access to approximately 3,450 square feet of FCD land running parallel to FCD right-of-way at San Timoteo Creek, south of Redlands Boulevard and west of Anderson Street, to manage and operate an underground electrical line and adjust the rental rate schedule, leaving two five-year options to remain.  All other terms and conditions of the License remain unchanged.

 

The project to approve the Amendment was reviewed pursuant to the California Environmental Quality Act (CEQA) and determined to be categorically exempt under Section 15301 - Existing Facilities (Class 1) because the proposed License is to secure property to operate within the existing structure with negligible or no expansion of existing use.  Accordingly, no further action is required under CEQA.
