RECOMMENDATION(S)
Recommendation
Acting as the governing body of County Service Area 70, Zone R-9 (Rim Forest):
1. Find that the County Service Area 70, Zone R-9 (Rim Forest) Road Paving Project located in the Rim Forest area is exempt under the California Environmental Quality Act Guidelines, Title 14 of the California Code of Regulations Section 15301(c), Class 1, Existing Facilities and Section 15302(c), Class 2, Replacement or Reconstruction.
2. Approve the County Service Area 70, Zone R-9 (Rim Forest) Road Paving Project as defined in the Notice of Exemption.
3. Approve the specifications for the County Service Area 70, Zone R-9 (Rim Forest) Road Paving Project.
4. Authorize the Director of the Department of Public Works to advertise the County Service Area 70, Zone R-9 (Rim Forest) Road Paving Project for formal bids.
5. Direct the Department of Public Works - Special Districts to file and post the Notice of Exemption in accordance with the California Environmental Quality Act.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost).
On November 14, 2023 (Item No. 91), the Board of Supervisors (Board) approved a $369,500 loan from the County Service Area Revolving Loan Fund, which is needed to fund the County Service Area 70, Zone R-9 (Rim Forest) Road Paving Project (Project). County Service Area 70, Zone R-9 (District) will repay this loan, including interest at the County Treasurer rate within 10 years from disbursement, with revenue from a per parcel service charge that was previously approved by the property owners residing in the District. This service charge will generate annual revenue of $43,300 (141 parcels at $307.09 per parcel) for a period of 10 years.
Sufficient appropriation for the Project is included in the County Service Area 70 Countywide Capital Improvement Program fund 2024-25 budget and will be included in future recommended budgets, as needed.
BACKGROUND INFORMATION
The District was formed in 1983 to provide road maintenance and snow removal services for 38 parcels in Rim Forest. Annexation of additional properties in 1989 (39 additional parcels) and 1990 (64 additional parcels) created the current District boundaries. The Project proposes to pulverize and repave approximately 5,134 linear feet of existing roadways along Lakeview Drive, Hazel Place, Park Place, Scenic Way, Valley View Drive, and Scenic Place in the Rim Forest area.
Department staff reviewed the Project and determined that a categorical exemption in accordance with the California Environmental Quality Act (CEQA) Guidelines, Title 14 of the California Code of Regulations, Section 15301(c) Class 1 and Section 15302(c), Class 2 is appropriate. The Class 1 exemption allows for repair and maintenance activities on existing public facilities that involve negligible or no expansion of use beyond that existing at the time of the lead agency’s determination. The Class 2 exemption allows the replacement or reconstruction of existing utility systems and/or facilities involving negligible or no expansion of capacity. When the Board considers the environmental finding, the filing and posting of a Notice of Exemption is recommended.
In addition to the CEQA finding, this item seeks Board approval of the Project’s specifications and authorization to advertise for bids.
PROCUREMENT
Upon approval of this item, the Project will be advertised in accordance with Section 22037 of the California Public Contract Code. The Department anticipates returning to the Board in September 2024 with a recommendation for award of the construction contract.
