Approve Amendment No. 4 to Agreement No. 09-429 with Kern County to extend the Agreement through June 30, 2024 for Kern County to accept residential solid waste from the San Bernardino County communities of Four Corners, Red Mountain, and Windy Acres, for disposal at Boron Sanitary Landfill, Ridgecrest Sanitary Landfill, and Randsburg Transfer Station, at a cost of $34,240 for 2022-23 to be adjusted each year based on Kern County’s disposal fees.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost) as the Department of Public Works - Solid Waste Management Division (SWMD) is financed by fee revenue. SWMD establishes fees that are charged to the public and other agencies for utilization of the County’s Waste Disposal System. The estimated total cost of this two-year Agreement extension is $68,480 ($34,240 annually), subject to future annual disposal fee rate adjustments approved by the Kern County Board of Supervisors. Sufficient appropriation has been included in the SWMD 2022-23 recommended budget and will be included in future recommended budgets.
BACKGROUND INFORMATION
Under the proposed amendment, SWMD will pay $160 for each of the 189 improved single-family residential parcels identified in the County Assessor’s records for a total annual amount of $30,240. During prior negotiations, SWMD staff agreed with Kern County to also include payment for additional parcels to account for improvements that are currently in process or planned for the future that will require solid waste disposal services. SWMD estimates potential growth of 25 parcels at $160 per parcel, for a total annual amount of $4,000. San Bernardino County does not operate a solid waste disposal facility within a reasonable distance of the Service Area. In order to facilitate necessary refuse disposal service for these San Bernardino County residents and to minimize operational cost to both counties, on June 2, 2009 (Item No. 26) San Bernardino and Kern Counties entered into Agreement No. 09-429. On June 28, 2011 (Item No. 91) the Board of Supervisors (Board) approved Amendment No. 1 to the Agreement to reflect increased disposal costs implemented by Kern County. On June 5, 2012 (Item No. 56) the Board approved Amendment No. 2 to the Agreement which extended it for five years and then again on June 13, 2017 (Item No. 69) the Board approved Amendment No. 3 to extend the contract for an additional five years. Due to significant increases in the per parcel rates charged to SWMD over the past two years (93% increase from 2020-21 rates), SWMD is requesting a two-year extension of this agreement instead of a five-year extension in order to allow time to analyze the potential cost impacts and potentially determine if a different solution exists.
