Recommendation
1. Acting as the governing body of the In-Home Supportive Services Public Authority, approve the Memorandum of Understanding with San Bernardino County through its Human Services Administration to receive payment support for In-Home Supportive Services provider benefits through fund transfers for the period of March 1, 2026, through February 28, 2031.
2. FINANCIAL IMPACT
Approval of this item does not impact Discretionary General Funding (Net County Cost). Human Services Administration (HS ADM) will advance local share funding to the In-Home Supportive Services Public Authority (IHSS PA) to support IHSS PA’s cash flow ability to allow them to pay provider benefit contributions and will be fully reimbursed once IHSS PA receives full reimbursement from the California Department of Social Services (CDSS). Adequate appropriation and revenue have been included in the HS ADM 2025-26 budget and the IHSS PA budget and will be included in future recommended budgets.
BACKGROUND INFORMATION
Established in 1973, the In-Home Supportive Services (IHSS) Program provides elderly, blind, or disabled individuals with the assistance needed for them to remain in their homes rather than enter institutional care. Individuals receiving assistance through this program utilize IHSS providers (Providers), who perform a wide variety of basic care services including house cleaning, meal preparation, laundry, shopping, personal care, transportation, and protective supervision.
On January 8, 2002, the Board of Supervisors (Board) adopted Ordinance No. 3842 (Item No. 58) pursuant to Section 12302.25 of the Welfare and Institutions Code to establish IHSS PA as the employer of record for Providers for the purpose of collective bargaining.
On September 12, 2023 (Item No. 77), the Board and Board of Directors approved the IHSS Provider Unit Memorandum of Understanding (MOU) between IHSS PA and Service Employees International Union Local 2015, covering Provider wages and benefits for the period of September 23, 2023 through June 30, 2026. This agreement obligates IHSS PA to make financial contributions toward Provider benefits through the Healthcare Employees/Employers Dental and Medical Trust.
Under this recommended MOU, HS ADM will continue to assist IHSS PA in meeting this financial obligation by transferring funds to IHSS PA upon receipt of a monthly invoice indicating the total cost of Provider benefits for that month. This MOU formalizes an existing administrative practice that has been used to support IHSS PA’s cash flow while awaiting reimbursement from CDSS. As IHSS PA receives quarterly reimbursement from CDSS, IHSS PA will subsequently reimburse HS ADM on a quarterly basis. The total amount transferred under the MOU shall not exceed the amount specified on the monthly invoice submitted by IHSS PA.
This MOU may be terminated by either party without cause with 30 days’ written notice. If federal and/or state funds allocated to HS ADM are reduced, HS ADM may immediately decrease the funds transferred to IHSS PA or terminate the MOU upon written notice.
