Recommendation
Acting as the governing body of the San Bernardino County Flood Control District:
1. Conduct a public hearing on proposed ordinance that repeals No. FCD 25-01, which established the current fees, and adopts the new San Bernardino County Flood Control District Fee Ordinance that sets forth the fees to be charged by the San Bernardino County Flood Control District for Fiscal Years 2026-27, 2027-28, and 2028-29, for its various products and services.
2. Make alterations, if necessary, to proposed ordinance.
3. Approve introduction of proposed ordinance.
• An ordinance of the San Bernardino County Flood Control District, State of California, to repeal Ordinance No. FCD 25-01 and to establish fees related to products and services.
4. SCHEDULE ORDINANCE FOR FINAL ADOPTION ON TUESDAY, APRIL 7, 2026, on the Consent Calendar.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). This action will allow the San Bernardino County Flood Control District (District) to establish a fee structure in order to recover costs associated with providing products and services to the public. Fees for the District are estimated to generate approximately $1.4 million in revenue for 2026-27. Sufficient appropriation and revenue will be included in the District’s 2026-27 recommended budget and future recommended budgets.
BACKGROUND INFORMATION
On an annual basis, the District introduces a fee ordinance to the Board of Supervisors (Board), which typically includes fee revisions, the deletion of fees, and the addition of new fees. This item will authorize the actions necessary to repeal the existing 2025 District Fee Ordinance and establish the District Fee Ordinance that sets forth the fees to be charged by the District for fiscal years 2026-27, 2027-28, and 2028-29 for its various products and services in order to recover the District’s costs. This action is aligned with the Board’s goals and objectives by ensuring all fee amounts are accurate and reasonable, allowing the District to operate in a fiscally-responsible and business-like manner.
On April 8, 2025 (Item No. 70), the Board adopted the 2025 District Fee Ordinance No. FCD 25-01 that established the District’s current fees. The District’s fees represent the estimated cost of providing various products and services.
As part of the District’s annual fee review, staff reviewed the 2025 District Fee Ordinance and are proposing revisions, with notable changes summarized below:
• Hourly classification rates and the majority of flat fees are being revised using a standard fee inflator of 3%. This adjustment aligns with the County’s multi-year fee approval cycle, which establishes most fees for 2026-27 along with increases for the following two years. The 3% inflator provides a consistent and transparent method to address rising labor and service delivery costs, supporting sustainable cost recovery, efficient administration, and continued high-quality public service.
• The District is proposing to change the minor construction review initial deposit, minor construction inspection initial deposit, major construction review initial deposit, major construction inspection initial deposit, and the surplus property appraisal review and administration deposit fee amounts to more accurately reflect the average cost associated with performing these services.
• The District is also proposing to delete the eight fees for reproduction services of maps, exhibits, plans and miscellaneous documents, as it was determined they are no longer needed due to information being available electronically.
On March 10, 2026 (Item No. 62), a fee workshop with the Board was conducted to discuss the 2026-27 proposed fees. Since the presentation of the District’s fees at this workshop, no revisions have been made.
The proposed fee ordinance will go into effect 30 days after adoption but the effective date of any new fees is July 1, 2026, following final adoption by the Board on Tuesday, April 7, 2026.
