RECOMMENDATION(S)
Recommendation
1. Acting as the governing body of the County of San Bernardino approve Agreement with the San Bernardino County Fire Protection District for the County of San Bernardino to reimburse the San Bernardino County Fire Protection District - Hazardous Materials Division for incident response involving hazardous materials associated with Probation Department uniforms, equipment, gear and workstations, in an amount not to exceed $125,000, for the period of April 6, 2021 through June 30, 2026.
2. Acting as the governing body of the San Bernardino County Fire Protection District approve Agreement with the County of San Bernardino, for the County of San Bernardino to reimburse the San Bernardino County Fire Protection District - Hazardous Materials Division for incident response involving hazardous materials associated with Probation Department uniforms, equipment, gear and workstations, in an amount not to exceed $125,000, for the period of April 6, 2021 through June 30, 2026.

FINANCIAL IMPACT
Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost). The Probation Department (Probation) will reimburse the San Bernardino County Fire Protection District - Hazardous Materials Division (HAZMAT) for any costs incurred from hazardous materials response in an amount not to exceed $125,000. Sufficient appropriation is included in the 2020-21 Probation and HAZMAT budget and will be included in future recommended budgets.
BACKGROUND INFORMATION
HAZMAT is designated by the California Environmental Protection Agency as the Certified Unified Program Agency with staff trained and equipped to respond to emergency incidents involving spilled or deposited hazardous materials and has the resources to manage and investigate such incidents. Probation has the need for hazardous/infectious materials evaluation and decontamination or destruction services of clothing, equipment, gear and/or workstations.
Under this Agreement, HAZMAT provides assessments and disposes of clothing, equipment, gear or workstations, if necessary, in accordance with federal, state and County laws, regulations, policies and guidelines. Probation will reimburse HAZAMAT for personnel and any expense incurred for cleansing or destruction of the clothing, equipment, gear and/or workstations. The Agreement may be terminated by either party with a thirty (30) days’ written notice.
