RECOMMENDATION(S)
Recommendation
1. Approve Addendum No. 1, issued on August 26, 2024, Addendum No. 2, issued on September 4, 2024, Addendum No. 3, issued on September 12, 2024, and Addendum No. 4, issued on September 20, 2024, to the bid documents for the Mission Zanja Bridge Project on the Santa Ana River Trail in the San Bernardino area.
2. Award a construction contract to KEC Engineering Corporation (Corona, CA) in the amount of $2,473,897.22 for the Mission Zanja Bridge Project on the Santa Ana River Trail in the San Bernardino area.
3. Authorize a contingency fund of $247,389 for the Santa Ana River Trail in the San Bernardino area.
4. Authorize the Director of the Department of Public Works to approve the expenditure of the contingency fund of $247,389 for verified quantity overruns for this unit priced construction contract.
5. Authorize the Director of the Department of Public Works to order any necessary changes or additions in the work being performed under the contract for a total amount not to exceed $136,194 of the $247,389 contingency fund, pursuant to Public Contract Code section 20142.
6. Authorize the Director of the Department of Public Works to accept the work when 100% complete and execute and file the Notice of Completion.
7. Authorize an allocation of $2,407,856 from the Community Service Upgrades General Fund Reserve for the Mission Zanja Bridge Project over the Santa Ana River Trail in the San Bernardino area for the increased cost in construction, construction engineering, and construction contingency.
8. Authorize the Auditor-Controller/Treasurer/Tax Collector to post necessary budget adjustments, as detailed in the Financial Impact section (Four votes required).

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The Mission Zanja Bridge Project over the Santa Ana River Trail in the San Bernardino Area (Project) cost was originally estimated in early 2022, however the cost for construction and materials has increased significantly due to design changes addressing concrete rock slope protection to safeguard the abutment from river impacts and an additional retaining wall to prevent encroachment on the surrounding property. The Project budget estimate has increased to $2,894,460, which will be funded with approximately $486,604 of California State Coastal Conservancy (Conservancy) grant funds managed by the Regional Parks Department (Parks) in coordination with the Department of Public Works (Department). Parks is requesting an allocation of $2,407,856 from the Community Service Upgrades General Fund Reserve, which includes the $1,987,293.22 to fund the remaining cost for construction, construction engineering, and any use of construction contingency.
The following adjustments to the 2024-25 budget are necessary to transfer funding to the Department and increase the Project budget:

BACKGROUND INFORMATION
The Project work consists of the placement of a prefabricated bridge over the Mission Zanja River with concrete abutments and wingwalls, stripping, excavation, and other work appurtenant thereto. The Project is part of the Santa Ana River Trail Phase III Project (SART Phase III). The Santa Ana River Trail (SART) is expected to extend from the Pacific Ocean to the San Bernardino County Mountains. The County is responsible for the completion of 21.5 miles of the SART, which has been divided into four phases between the Riverside County/San Bernardino County line and the Mentone area. SART Phase Ill, a 3.8-mile trail segment on the south side of the Santa Ana River, from Waterman Avenue in the City of San Bernardino to California Street in the City of Redlands, will consist of installing the regional trail to include a bicycle trail, bridges, culverts, and access ramps.
On December 16, 2014 (Item No. 67), the Board of Supervisors (Board) adopted the Mitigated Negative Declaration pursuant to the California Environmental Quality Act (CEQA), approved the Notice of Determination and directed the Clerk of the Board to file and post said notice as required by CEQA.
Following Board approval of this item, construction is anticipated to commence December 2024 and be completed by October 2025.
PROCUREMENT
On August 6, 2024 (Item No. 40), the Board approved the Project’s plans and specifications, as well as authorized the Director of the Department to advertise the Project for bids. This Project was advertised in the San Bernardino County Sun Newspaper on August 13, 2024, and released on the County electronic procurement network (ePro) on August 13, 2024. Notice inviting bids were also provided to specified construction trade journals identified pursuant to Public Contract Code section 22036. On September 26, 2024, the following bids were received:

The following addenda were issued during the bidding phase.
Addendum No. 1: Revised the bid opening time to 10:00 a.m., September 12, 2024. Amended the Notice to Bidders on NB-1, NB-2, and NB-3.
Addendum No. 2: Amended the Special Provisions Section 10. Amended the Plans, delete Plan sheets 2 of 10 through 5 of 10. Added soils reports.
Addendum No. 3: Revised the bid opening time to 10:00 a.m., September 26, 2024.
Addendum No. 4: Answered questions and plan revisions.
Addendum No. 4 included design changes resulting from questions submitted by potential contractors. These changes increased the project costs by requiring additional measures such as increased rock slope protection, concreted rock slope protection to safeguard the abutment from river impacts, and an additional retaining wall to prevent encroachment on the Railroad property.
The Department has reviewed the bids received and determined that they are responsive and recommends entering into a contract with KEC Engineering Corporation, the responsive lowest responsible bidder. No appeal/protest letters were received.
This Project will have a ten percent contingency fund of $247,389 to compensate the contractor for verified quantity overruns as well as changes in the contract under certain circumstances. Under an established formula based on the contract amount, Public Contract Code section 20142 allows the Board to authorize the Director of Public Works to order changes in the contract, including for unforeseen conditions or design shortfalls, should they become necessary in the future, for a total amount not to exceed $136,194 of the $247,389 contingency fund.
