Recommendation
Acting as the governing body of County Service Area 70:
1. Conduct a public hearing to consider formation of County Service Area 70 Zone SL-11 Bloomington and establishment of a service charge to fund streetlight services and administrative costs of the proposed zone.
2. Adopt resolution:
a. Approving the formation of County Service Area 70 Zone SL-11 Bloomington for streetlight services.
b. Establishing an annual service charge of $1,544.00 per parcel, with up to 4.0% annual inflationary factor, on parcels within the boundaries of County Service Area 70 Zone SL-11 to fund streetlight services and administrative costs.
c. Directing the Clerk of the Board of Supervisors to proceed with various actions in regards to the formation of County Service Area 70 Zone SL-11, including filing of the resolution and related boundary map with the County Assessor and State Board of Equalization.
3. Authorize the Auditor-Controller/Treasurer/Tax Collector’s office to place the $1,544.00 per parcel service charge for County Service Area 70 Zone SL-11 on the annual tax bills beginning in FY 2020-21.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). Howard Industrial Partner LLC. (Developer) has paid all costs concerning formation of the proposed zone. The annual service charge of $1,544.00 per parcel, with up to 4.0% annual inflationary factor, will be billed on Assessor Parcel Number (APN) 0260-131-14 & 15 within the zone. Revenue from this service charge ($3,088.00 for FY 2020-2021) will be used to pay for the zone’s annual streetlight energy charges and administrative costs.
BACKGROUND INFORMATION
The Developer is developing APN 0260-131-14 & 15 for construction of a parking lot to accommodate 1,561 FedEx parking spaces on 64.8 acres in Bloomington. As part of the conditions of approval, the Developer is required to install five streetlights and provide an ongoing financing mechanism for the streetlight energy costs. This development is within the County Service Area (CSA) 70 sphere of influence and is located at 12685 Holly Street in the unincorporated area of San Bernardino County.
The Special Districts Department has been collaborating with the Developer to ensure that the streetlight planning requirements of the development are met and that financing for the streetlight services are provided on an ongoing basis. The Developer, who is the sole owner of all properties, has petitioned the Board of Supervisors for formation of CSA 70 Zone SL-11 and establishment of a service charge to fund the ongoing streetlighting costs.
As the sole owner of all land within the proposed CSA 70 Zone SL-11, the Developer has signed a “Waiver and Consent Regarding Mailed-Ballot Landowner Election” that thereby waives the requirement to publish public notice, various time-periods and mailed ballot voting/election related requirements in order to expedite approval of the zone’s formation. Pursuant to Section 25217(d) of the Government Code, the notice of public hearing was published and posted as required.
Approval of this item will provide ongoing financing for streetlight services needed for new development that will promote economic growth in the community of Bloomington.
