Recommendation
Acting as the governing body of Board Governed County Service Area 70 (CSA 70):
1. Conduct a public hearing to consider formation of CSA 70 Zone SL-7 Mentone and establishment of a service charge to fund streetlight services and administrative costs of the proposed zone.
2. Adopt resolution:
a. Approving the formation of CSA 70 Zone SL-7 for streetlight services.
b. Establishing an annual service charge of $50.68 per parcel, with up to 4% annual inflationary factor, on parcels within the boundaries of CSA 70 Zone SL-7 for streetlight services and administrative costs.
c. Direct the Clerk of the Board of Supervisors to certify the passage of this resolution, including filing of the resolution and related boundary map with the County Assessor and State Board of Equalization.
3. Authorize the Auditor-Controller/Treasurer/Tax Collector’s office to place the $50.68 per parcel service charge for CSA 70 Zone SL-7, with an annual inflationary increase of up to 4% thereafter, on the annual tax bills beginning in 2020-21.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). RSI Communities (Developer) has paid all costs related to formation of the proposed zone. The annual service charge of $50.68 per parcel, with up to 4% annual inflationary factor, will be billed on 62 parcels within the zone. Revenue generated annually from this service charge ($3,142.16 beginning in 2020-2021) will be used to pay the zone’s annual streetlight energy charges and administrative costs.
BACKGROUND INFORMATION
The Developer is in the process of developing Tract Map 19991 as a residential housing community containing 62 individual parcels on 16.89 acres in the county unincorporated area known as Mentone. The development is located on the northeast corner at the intersection of Sapphire Avenue and Nice Avenue. As part of the conditions of approval, the Developer is required to install five streetlights and to provide an ongoing financing mechanism for the streetlight energy costs.
The Special Districts Department has been collaborating with the Developer to ensure that the streetlight planning requirements of the development are met and that financing for the streetlight services are provided on an ongoing basis. The Developer, which is the sole owner of the property, has petitioned the Board of Supervisors for formation of CSA 70 Zone SL-7 and establishment of a service charge to fund the ongoing streetlighting costs.
As the sole owner of all land within the proposed CSA 70 Zone SL-7, the Developer has signed a “Waiver and Consent Regarding Mailed-Ballot Landowner Election” that thereby waives the requirement to publish public notice, various time-periods and mailed ballot voting/election related requirements in order to expedite approval of the zone’s formation. Pursuant to Section 25217(d) of the Government Code, the notice of public hearing was published and posted as required.
Approval of this item will provide financing of streetlight services to the new development that will promote economic growth in the community of Mentone.
