Approve Amendment No. 1 to Utility Agreement No. 24-311 with the East Valley Water District, under which San Bernardino County will fund the relocation of East Valley Water District’s waterline facilities that conflict with the Little Third Street and Little Tippecanoe Avenue Project in the San Bernardino area, at a not-to-exceed amount of $837,134, for a term of April 9, 2024 and terminate upon receipt of a Notice of Completion of the project, or April 9, 2027, whichever occurs first.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The Little Third Street and Little Tippecanoe Avenue Project in the San Bernardino area (Project) is funded with Gas Tax, Measure I Local Streets Program San Bernardino Valley Subarea, and anticipated Federal Congressionally Directed Spending revenue. The Project’s waterline relocations will be funded with Measure I Local Streets Program San Bernardino Valley Subarea funds. Sufficient appropriation and revenue are included in the Department of Public Works (Department) 2024-25 Road Operations budget (6650002000 34H15122/TX1825) and will be included in future recommended budgets.
BACKGROUND INFORMATION
On April 9, 2024 (Item No. 46) the Board of Supervisors (Board) approved Utility Agreement No. 24-311 (Agreement) with East Valley Water District (District) for Waterline Relocations for the Project, in the amount of $464,888. The Agreement provides for the relocation of the District’s waterlines, water meters, fire hydrants, and appurtenant structures that would be impacted by the Project, with the District to be the lead agency for the design and relocation work. However, competitive bidding results required an amendment due to increased project costs.
Subsequent to the Board’s approval of the Agreement, the District advertised the Project for competitive bids and received the lowest responsive bid in the amount of $543,280 for the construction work involved in the waterline relocations. Approval of this amendment will increase the contract amount to a new not-to-exceed amount of $837,134. This includes an estimated total amount of $126,427 for hydrostatic testing, inspection, soil testing, design plans, and District administrative fees, as well as a 25% increase over the project cost estimate of $167,427, as shown in Exhibit A of the Agreement. Approval of this amendment will update the Agreement to further specify the cost breakdown between the County and the District for the construction work for the relocation, as well as updating certain portions of the contract language to comply with the California State Department of Transportation’s requirements.
