RECOMMENDATION(S)
Recommendation
1. Consent to the withdrawal of bid by Urban Professional Builders, Inc. of Pasadena, due to a material mathematical error in its bid, as allowed under Public Contract Code section 5101 and 5103.
2. Reject the remainder of bids received on March 31, 2022, for the Probation West Valley Training Center Gun Range A/C Installation Project, finding the rejection of the bids in the best general interest of the County.
3. Approve the plans and specifications for the Probation West Valley Training Center Gun Range A/C Installation Project, located at 9478 Etiwanda Avenue in Rancho Cucamonga.
4. Authorize the Director of the Project and Facilities Management Department to advertise for competitive re-bids for the Probation West Valley Training Center Gun Range A/C Installation Project.

FINANCIAL IMPACT
Approval of this item will not result in the use of additional Discretionary General Fund (Net County Cost). The Probation West Valley Training Center Gun Range A/C Installation Project (Project) (WBSE 10.10.1151) budget of $632,000 is funded with Proposition 172 as approved by the Board of Supervisors (Board) as part of the 2020-21 Capital Improvement Program (CIP) budget. Approval of necessary related budget adjustments is not requested at this time but will be included on a future mid-year countywide budget report or Board Agenda Item presented to the Board for approval.
BACKGROUND INFORMATION
Approval of this item will allow the Project and Facilitates Management Department (PFMD) to re-solicit for competitive bids for the Project located at 9478 Etiwanda Avenue in Rancho Cucamonga. Currently, the staff is experiencing extreme temperatures due to issues with airflow and temperature regulation. The Project will provide a solution to mitigate the high temperatures by installing a new air conditioning unit at the gun range to properly regulate ventilation and maintain accurate temperature control to enhance working conditions for staff.
On February 8, 2022 (Item No. 50), the Board found the Project to be exempt under the California Environmental Quality Act (CEQA) Guidelines (Title 14, California Code of Regulations), Section 15303, subsections (c)(d) New Construction and directed the Clerk of the Board of Supervisors to file and post the Notice of Exemption for the Project. No additional CEQA review is required at this time.
On February 8, 2022 (Item No. 50), the Board also approved plans and specifications and authorized the advertisement of bids for the Project. On March 31, 2022, the following six bids were received.

On April 4, 2022, PFMD received a letter from Urban Professional Builders, Inc., requesting to withdraw its bid citing a major clerical error in its bid proposal. After careful consideration, PFMD determined Urban Professional Builders, Inc. met the requirements under Public Contract Code section 5103 to allow the withdrawal of the bid, specifically, (1) a mistake was made in filling out the bid, (2) Urban Professional Builders, Inc. notified the San Bernardino County (County) of the mistake within five working days of the bid opening, and (3) the mistake materially altered the bid. The remainder of the bids came in considerably higher than the Project construction estimate.
PFMD has made revisions to license requirements and the construction estimate. PFMD expects that these changes will elicit bids closer to the estimated revised construction costs of $880,000. PFMD therefore recommends the Board reject all bids received on March 31, 2022, finding the rejection of the bids is in the best general interest of the County and authorize the Director of PFMD to re-advertise for bids for the Project.
This Project is consistent with County Administrative Office approved CIP request No. 21-165.
PROCUREMENT
PFMD will advertise for competitive bids for the Project on July 29, 2022. A mandatory pre-bid meeting for prospective bidders is scheduled to be conducted on August 10, 2022, at 10:00 a.m. at 9478 Etiwanda Avenue in Rancho Cucamonga. The bid opening for the Project is scheduled for August 31, 2022, at 2:00 p.m. at PFMD.
Public Contract Code section 22039 requires the Board to approve the plans and specifications for the Project. Plans and specifications are on file with the Clerk of the Board of Supervisors.
