Recommendation
Approve Amendment No. 1 to Agreement No. 23-1138 with Bergman KPRS, LLC, effective retroactively to December 31, 2024, for Consultation and Development of a Master Plan for Glen Helen Regional Park, to extend the contract term by six months, for a total contract term of November 1, 2023 through June 2, 2025, with no change to the contract amount.

FINANCIAL IMPACT
Approval of Amendment No. 1 (Amendment) to Agreement No. 23-1138 (Agreement) will not result in the use of Discretionary General Funding (Net County Cost). There are no additional costs associated with this recommendation.
BACKGROUND INFORMATION
On June 13, 2023 (Item No. 99), the Board of Supervisors (Board) approved $30,000,000 in Discretionary General Funding to the Community Service Upgrades Reserve Fund (Reserve) that was approved as part of the 2023-24 budget to fund Regional Parks Department (Department) revenue generating upgrades and amenity improvements.
On June 12, 2023, the Department released Request for Proposal (RFP) No. PARKS23- PARKS-5015 to advertise for competitive bids for the Glen Helen Market Study and Master Plan. The RFP was released through San Bernardino County’s Electronic Procurement System (ePro). A committee comprised of one representative each from the Real Estate Services Department, Project and Facility Management Department, and within the Department, was established to review the proposals. The committee recommended awarding the contract to Bergman as the most complete, best qualified and demonstrated bidder.
On October 24, 2023 (Item No. 61), the Board approved the Agreement with Bergman KPRS, LLC (Bergman) for consultation and development of a Glen Helen Regional Park Master Plan. The plan will include a market study of the park to identify revenue generating opportunities such as but not limited to, new amusement park level amenities, sporting venue(s), concert venue, equestrian and rodeo facilities, and similar entertainment amenities. The market study will involve research and reporting of public and stakeholder interests and impacts, development and management of facilities and programs designed to increase regional connectivity to include lodging considerations, visitor usage and demographics, and creation of implementation strategies, including cost/benefit analyses with short and long-term timelines. This amendment will provide additional time for Bergman to complete the Glen Helen Master Plan.
The Department is requesting a contract extension for Bergman to complete the Master Plan for Glen Helen Regional Park. The Department became aware of the need to extend the Agreement after it had already expired on December 30, 2024 and are requesting retroactive approval effective December 31, 2024. The Department spoke with Bergman who provided an explanation that they needed further time to thoroughly complete the project. Project funding will not be impacted only the completion date. If not approved the master plan will not be completed, and full details would not be seen by the County. The vendor has continued services in good faith that the contract will be extended, and the Department will monitor and follow up on invoicing and completion date monthly. The Department does not expect to have budget concerns or adjustments as the project is expected to be completed within the 2024-25 fiscal year. This item is being presented at the first available date following the required operational, administrative and legals reviews for presentation to the Board
The Park Master Plan supports the County and Chief Executive Officer goals and objectives to operate in a fiscally-responsible and business-like manner and ensure development of a well-planned, balanced, and sustainable County by presenting a cost/benefit analysis for proposed amenities at the Park to maximize revenue generation.
