Recommendation
1. Acting as the governing body of the San Bernardino County Flood Control District, approve Amendment No. 1 to Memorandum of Understanding, Contract No. 20-1228, with San Bernardino County, for various maintenance activities at regional parks and stockpiling at Yucaipa Regional Park, to extend the term by five years, for a total contract term of December 15, 2020 through June 30, 2030.
2. Acting as the governing body of San Bernardino County, approve Amendment No. 1 to Memorandum of Understanding, Contract No. 20-1228, with San Bernardino County Flood Control District for various maintenance activities at regional parks and stockpiling at Yucaipa Regional Park, to extend the term by five years, for a total contract term of December 15, 2020 through June 30, 2030.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The proposed Amendment No. 1 to Memorandum of Understanding, Contract No. 20-1228, (MOU) does not involve any financial exchange but facilitates a mutually beneficial arrangement, allowing the San Bernardino County Flood Control District (District) to continue to use a portion of the Yucaipa Regional Park for stockpiling debris material generated by storms in the El Dorado/Apple burn scar area. In exchange for the ability to stockpile, the District will make improvements to the site and conduct maintenance on the access roads. This item will have a positive impact on the District and San Bernardino County Regional Parks Department (Parks) through reduced maintenance costs by using each other’s existing resources in a more efficient manner when performing maintenance activities on their respective facilities, access roads, and related appurtenances. Sufficient appropriation for maintenance is included in the District’s and Parks’ 2024-25 budget and will be included in future recommended budgets.
BACKGROUND INFORMATION
On July 10, 2012 (Item No. 60), the Board of Supervisors (Board) approved Agreement No. 12-471 (2012 Agreement) between the District and Parks under which each could provide mutual maintenance activities to increase efficiency and reduce maintenance costs. The types of work included debris cleanup, repair of fencing, renting of equipment, brush clearing, trail repair, striping, drainage facility maintenance, and general labor work. There could be costs associated with this MOU if either the District or Parks asks the other to perform work, and the MOU outlines that the requesting party agrees to reimburse the other for work that is done.
The 2012 Agreement was in an outdated format and did not include a term end date. As such, on December 15, 2020 (Item No. 77), the Board terminated the 2012 Agreement and approved the MOU, that set forth the same scope of work as the 2012 Agreement as well as expanded the scope of the 2012 Agreement to allow the District to use a portion of the Yucaipa Regional Park for stockpiling debris material generated by storms in the El Dorado/Apple burn scar area. In exchange for the ability to stockpile, the District would make improvements to the site and conduct maintenance on the access roads.
The MOU term is from December 15, 2020, through June 30, 2025. The District and Parks now seek to exercise one of the two additional five-year extension options, to extend the term of the MOU for a total new contract term of December 15, 2020 through June 30, 2030. The MOU may be terminated by either party upon 30 days written notice. All other terms and conditions shall remain unchanged.
