Recommendation
Approve Amendment No. 1 to Construction Contract No. 24-1029 with PUB Construction, Inc., for the Prado RV Restroom Remodel Project located in Chino, adding to the scope of work, increasing the contract amount by $65,439, from $576,932 to $642,371, and extending the contract term by 175 calendar days, for a total contract term of 375 calendar days (Four votes required).

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The Prado RV Restroom Remodel Project (Project) (WBSE 10.10.1395) budget of $2,131,433 was approved on June 10, 2025 (Item No. 136), by the Board of Supervisors (Board) as part of the 2025-26 Capital Improvement Program (CIP) Budget. This contract amendment falls within the total Project budget.
BACKGROUND INFORMATION
The recreational vehicle (RV) area at Prado Regional Park, situated at 16700 Euclid Avenue in Chino, is in need of restroom facilities that cater to the requirements of individuals covered by the Americans with Disabilities Act (ADA). This Project encompasses the construction of new, easily accessible restroom facilities. Additionally, it involves establishing nearby ADA parking locations and ensuring that the pathway to the restrooms complies with ADA regulations.
On October 22, 2024 (Item No. 30), as the result of Request for Proposals No. ANE223-ANE2C-5449, the Board awarded Construction Contract No. 24-1029 (Contract) to PUB Construction, Inc., in the amount of $576,932, for a contract period of 200 calendar days from the date of the issuance of the Notice to Proceed for the Project.
Approval of Amendment No. 1 to the Contract, in the amount of $65,439, will cover the unanticipated costs due to unforeseen site conditions and design omissions. The additional costs are the result of unforeseen site conditions that arose during construction. Specifically, extra demolition and haul-off were required, along with the import and placement of soil to fill oversized slabs and footings that were identified at Restrooms Nos. 8, 14, and 16 during demolition.
In addition, schedule delays caused by these conditions necessitated extended site security fencing at the same restroom locations, further contributing to the overall costs. The design omissions include the installation of concrete benches, trash receptacles, water shut-off valves at restrooms Nos. 8, 14, and 16, three backflow cages with hinged slabs, and ADA parking reinforcement with #4 rebar. These modifications are essential to meet site conditions and ADA compliance standards. This amendment will extend the contract term by 175 calendar days, increasing the total contract term from 200 calendar days to 375 calendar days.
The unforeseen conditions and design errors and omissions resulting in the additional costs in Amendment No. 1 were discovered after the competitive bid process, and no additional procurement is required. This Project is consistent with County Administrative Office approved CIP Project No. 23-088. Public Contract Code section 20136 requires all construction contract amendments to have four vote approval by the Board.
