RECOMMENDATION(S)

Recommendation

Acting as the governing body of the San Bernardino County Flood Control District:

1.                     Approve Contract with BKF Engineers to provide professional civil engineering services for the design of Bandicoot Basin, in the amount not to exceed $1,115,632, for a contract term of February 1, 2025, to January 31, 2028.

2.                     Authorize the Chief Flood Control Engineer or the Assistant Director to add and/or delete services and reallocate funding between tasks as required to complete the work outlined in the Contract without increasing the total Contract amount or changing the term of the Contract.

FINANCIAL IMPACT

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The San Bernardino County Flood Control District (District) is funded by property taxes, fee revenue, and other local, state and federal funding. The total contract amount of $1,115,632 is based on the fees outlined in the proposal presented by BKF Engineers, which includes government fees permits, and consultant services for time and materials. Sufficient appropriation and revenue have been included in the District’s 2024-25 budget (1970002510) and will be included in future recommended budgets.

 

BACKGROUND INFORMATION

The Bandicoot Basin Project (Project) consists of the construction of a stormwater detention basin located within the City of Hesperia Sphere of Influence in unincorporated San Bernardino County (County). The proposed Project is listed in the Hesperia Master Plan of Drainage and is considered a Regional Facility. The Project will attenuate flow to reduce the potential for downstream flooding, in both large and small storm events, as part of the Master Plan System. Once completed, the Project will provide flood protection for the existing structures, residences, and businesses within the Project area.

 

On January 6, 2015, (Item No. 56), the Board of Supervisors (Board) adopted the Mitigated Negative Declaration for the Project, pursuant to the California Environmental Quality Act.

 

On  September 13, 2022, (Item No. 73), the Board authorized the purchase of mitigation credits from Desert Environmental Resources, Inc., in order to comply with the conditions of the Project, the United States Army Corps of Engineers Individual Permit, the Lahontan Regional Water Quality Control Board Section 401 Water Quality Standards Certification, and the California Department of Fish and Wildlife 1600 Lake and Streambed Alteration Agreement. Now that the environmental and regulatory requirements have been satisfied, the District may move forward with the design and construction of the Project.

 

The Project is consistent with the County and the Chief Executive Officer's goals and objectives to provide for the safety, health and social service needs of County residents by attenuating flows to reduce the potential for downstream flooding in both large and small storm events, and provide flood protection for the existing structures, residences, and businesses within the Project area.

 

Under the proposed contract, BKF Engineers will complete the Project design. The District anticipates returning to the Board for approval of the plans and specifications in Spring 2028.

 

PROCUREMENT

The Department of Public Works approved and authorized the release of Request for Proposal (RFP) No. PWG124-FLOOD-5451 with the Purchasing Department on July 22, 2024, to solicit proposals from interested and qualified agencies to provide professional civil engineering services to design a district master planned facility for a period of three years. The RFP was posted to the County’s Electronic Procurement Network (ePro).

 

Three proposals were received by the established deadline in response to the RFP. Proposals from the three agencies listed below met the minimum requirements and continued through the evaluation process.

The evaluation panel, with representation from the District, reviewed and evaluated the proposals based on the criteria listed in the RFP. The criteria included: qualifications and experience, technical review, and references.

 

Based on the evaluation criteria, the evaluation panel determined that BKF Engineers best met the needs of the County. Evaluation and selection emails were sent to all responsible and responsive proposers on December 02, 2024. No protests were received within the allowable period.

 

Purchasing supports this competitive procurement based on the formal solicitation described above.
