Recommendation
Approve Amendment No. 2 to Agreement No. 22-739 with Columbia Ultimate Business Systems, LLC to extend software licensing, support and maintenance of the proprietary Revenue Plus Collector System by an additional six months, for the total contract period of July 1, 2022, through December 31, 2025, increasing the contract by $85,648, for a total contract amount of $902,316.

FINANCIAL IMPACT
Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost). The additional contract cost for these services will be reimbursed through collection revenue within the Auditor-Controller/Treasurer/Tax Collector’s (ATC) Net County Cost allocation. Sufficient appropriation and revenue have been included in ATC’s 2024-25 budget and 2025-26 Recommended Budget.
BACKGROUND INFORMATION
ATC’s Revenue Recovery Division (RRD) provides debt collection services to San Bernardino County (County) departments and the Superior Court. For over 40 years, RRD has used the proprietary Revenue Plus Collector System (RPCS) as its primary software application to perform all facets of collection activity, including maintaining account history, notating correspondence, managing balances and payments, sending letters, submitting accounts to tax intercept, tracking workflow, and interfacing automated batch jobs for demographic information. RPCS is scheduled to sunset on December 31, 2025. RRD is in the process of replacing this core debt collection system and will continue using RPCS until the replacement system goes live.
On August 9, 2022 (Item No. 13), the Board of Supervisors (Board) approved a non-competitive Agreement No. 22-739 (Agreement) with Ontario Systems, LLC d/b/a Finvi (Finvi) for software licensing, support, and development of the proprietary RPCS in the amount of $816,668 retroactively for the three-year period of July 1, 2022, through June 30, 2025. Columbia Ultimate Business Systems, LLC (CUBS), a subsidiary of Finvi, developed and administers the proprietary RPCS software.
In January 2024, Avenu Holdings, LLC (Avenu) acquired the State and Local Government portion of Finvi, making CUBS an affiliate and wholly owned subsidiary of Avenu. Due to this change in ownership, on December 3, 2024 (Item No. 12), the Board approved Amendment No. 1 to the Agreement with Finvi to assign the Agreement to CUBS, retroactive to February 1, 2024, and ending on June 30, 2025, with no other changes to the existing contract.
The recommended amendment will extend the Agreement with CUBS for software licensing, support and maintenance of RPCS by an additional six months to allow RRD to continue providing debt collection services to County departments and the Superior Court until RRD goes live with a replacement collection system.
PROCUREMENT
The Purchasing Agent supports the continued use of a non-competitive procurement for proprietary computer software licensing services based on the existing Agreement until the replacement solution is implemented.
The continued use of CUBS’s proprietary RPCS software licensing, support, and development will ensure the continued support of RRD’s primary software application, which is needed to perform all facets of collection activity.
