Recommendation

Approve Amendment No. 2 to the following contracts, for the provision of graffiti removal services, extending the term for an additional year, for a total contract period of March 23, 2021, through June 30, 2026, with no change to the total not-to-exceed aggregate amount of $825,000:

1.                     Urban Graffiti Enterprises, Inc., Contract No. 21-210

2.                     Graffiti Protective Coatings, Inc., Contract No. 21-211

FINANCIAL IMPACT

Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost). Up to date, out of the contract aggregate total of $825,000, $495,369 has been expended, with $329,631 remaining. Adequate appropriation is included in the Land Use Services (LUS) Department, Code Enforcement Division (CEN) 2024-25 budget, and will be included in future recommended budgets.

 

BACKGROUND INFORMATION

CEN is the designated code enforcement agency for the County’s unincorporated areas. CEN is responsible for protecting the public’s safety in accordance with County ordinances, including those pertaining to public nuisance conditions, such as graffiti. The most effective way to discourage future acts of graffiti vandalism and the spread of graffiti is by quickly removing existing graffiti. LUS does not have the staffing with the expertise or the equipment to perform graffiti abatement to a high professional standard, by color matching the surface that is being painted over in removing the graffiti.

 

On March 23, 2021, (Item No. 42), the Board of Supervisors (Board) approved Contract No. 21-210 with Urban Graffiti Enterprises, Inc., and Contract No. 21-211 with Graffiti Protective Coatings, Inc., for the provision of graffiti removal services. The total aggregate amount for the contracts was not-to-exceed the amount of $525,000, for the period of March 23, 2021, through June 30, 2024, with two one-year options to extend.

 

On January 23, 2024, (Item No. 37), the Board approved Amendment No. 1 to the contracts identified above, increasing the aggregate not-to-exceed total by $300,000, from $525,000 to $825,000, and extending the term for an additional year, for a total contract period of March 23, 2021, through June 30, 2025.

Approval of the recommended amendment will exercise the second of the two one-year options to extend the contracts. This extension is intended to facilitate the ongoing utilization of contracts with Urban Graffiti Enterprises, Inc., and Graffiti Protective Coatings, Inc., for the delivery of graffiti removal services across the County’s unincorporated areas, in a prompt and efficient manner. It is crucial to secure the services expeditiously, as required, throughout the unincorporated areas of the County by deploying certified and qualified contracted personnel on an as-needed basis.
