Approve Program Supplement Agreement No. R92 to State Funding Master Agreement No. 00009S with the State of California Department of Transportation, which allocates $1,118,000 of Senate Bill 1 Active Transportation Program Augmentation funds as reimbursement for road widening and construction of Class II bike lanes on Sunburst Avenue in the Joshua Tree area.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The Department of Public Works (Department) is funded by Gas Tax revenue, fee revenue, and other state and local funding. The total cost to widen Sunburst Avenue and construct Class II bike lanes in the Joshua Tree area (Project) is $1,118,000. The cost of the Project will be fully reimbursed through Senate Bill 1 Active Transportation Program (ATP) grant funds through the State of California Department of Transportation (Caltrans), which does not require a local match. Sufficient appropriation and revenue for the Project will be included in the Department’s Road Operations 2021-22 recommended budget (6650002000).
BACKGROUND INFORMATION
The proposed Project will widen the roadway and install Class II bike lanes, beginning at the terminus of the existing Class I bike lane on Sunburst Avenue and extending 1.5 miles north to the new Joshua Tree Elementary school in the Joshua Tree Area.
In April 2016, the Governor of the State of California signed into law Senate Bill 1 (SB 1), the Road Repair and Repair and Accountability Act of 2017 (Act), which provided new funding for road maintenance and transportation programs through the imposition of additional motor fuel taxes and vehicle license fees. Included in the programs established by the Act was augmented funding for active transportation grants and programs.
On May 24, 2016 (Item No.121), the Board of Supervisors (Board) authorized the submission of a grant application for the Project to Caltrans for the Active Transportation Program Cycle 3. The County submitted a grant application for the Project and was successful in securing competitive grant funds provided by the Act.
On April 17, 2018 (Item No. 38), the Board approved the acceptance of $1,118,000 in Augmented 2017 Active Transportation Program Cycle 3 grant funds for the Project.
On November 6, 2018 (Item No. 28) the Board approved a previous Program Supplement Agreement No. R92 to Master Agreement No. 00009S, (County Agreement No. 18-811) between the County and Caltrans to allocate $15,000 in Senate Bill 1 Active Transportation Program Augmentation funds as reimbursement for the $15,000 in costs for the environmental studies and permits phase of the Project
In accordance with Master Agreement No. 00009S, approval of a Program Supplement Agreement is required for each specific project and prior to County invoicing for reimbursement of costs associated with the project. The Program Supplement is governed by State Funding Master Agreement No. 00009S, which was approved between the County and Caltrans on March 27, 2007 (Item No. 13). The Program Supplement Agreement identifies the nature of a project and specifies the State administered funds available for reimbursement.
This Program Supplement Agreement will allow the Department to submit invoices to Caltrans for reimbursement of up to $1,118,000 in Project costs. Construction of the Project is anticipated to commence in the Summer of 2021.
This item meets the County and the Chief Executive Officer’s goals and objectives by working with Caltrans to ensure that the necessary agreements are processed in accordance with Caltrans guidelines to receive State SB 1 funds as reimbursement for Project costs.
