Recommendation
1. Authorize the purchase of one unbudgeted DC Fast Charge Electric Vehicle Service Equipment Tester, including a quote with non-standard terms, for testing the accuracy of high current output charging stations, for a total cost of $112,506.
2. Authorize the Auditor-Controller/Treasurer/Tax Collector to post budget adjustments, as indicated in the Financial Impact section (Four votes required).

FINANCIAL IMPACT
Approval of this item will not result in use of the Discretionary General Funding (Net County Cost). The Department of Agriculture / Weights & Measures (AWM) will fund the DC Fast Charge Electric Vehicle Service Equipment Tester with a budget adjustment in the amount of $112,506 from salary savings resulting from staffing vacancies. This item authorizes the Auditor-Controller/Treasurer/Tax Collector to post adjustments to AWM’s 2022-23 budget as follows:

BACKGROUND INFORMATION
The DC Fast Charge Electric Vehicle Service Equipment Tester will be used to ensure that commercially operated electric vehicle charging stations that provide high current output are accurate and that the amount assessed for the kilowatt per hour is correct. AWM will be implementing a new Weights & Measures program with Electric Vehicle Charging Station (EVCS) registration and testing. It will utilize the new DC Fast Charge Electric Vehicle Service Equipment Tester to test high current output charging stations and a previously purchased Electric Vehicle Service Equipment Low Current Tester to test low current output charging stations. The EVCS program will be responsible for carrying out the registration and inspection of all commercial charging stations within the County. The EVCS program requiring AWM to ensure equipment accuracy is state mandated. The key objectives of the EVCS program are to protect consumers from financial harm, ensure an equitable transaction and promote a safe charging experience. To ensure that each charging station is operating within specification and allowable tolerance, AWM will be using the DC Fast Charge Electric Vehicle Service Equipment Tester and a previously purchased Electric Vehicle Service Equipment Low Current Tester to complete the inspections for the EVCS program.
For 2023-24, the EVCS program will be operating as a pilot program to determine how many commercially operated electric vehicle charging stations there are countywide and what the cost will be to AWM to test each station. The data collected will be used to develop registration fees that will be presented to the Board of Supervisors for approval in the Fiscal Year 2024-25 Fee Workshop.
The Eastern Specialty Company (TESCO) price quote (Quote) for the DC Fast Charge Electric Vehicle Service Equipment Tester contains one non-standard term that differs from the County standard contract:
1. The Quote’s payment terms are Net 30 days.
• The County standard contract includes a Net 60 day payment term.
• Potential Impact: Inclusion of this non-standard term will require payment by the earlier date.
AWM recommends approval of the purchase of one unbudgeted DC Fast Charge Electric Vehicle Service Equipment Tester, including the non-standard term in the Quote, as the DC Fast Charge Electric Vehicle Service Equipment Tester is an efficient method in testing the accuracy of high current output charging stations and meets the necessary state requirements.
PROCUREMENT
AWM will purchase the DC Fast Charge Electric Vehicle Service Equipment Tester from TESCO. The TESCO DC Fast Charge Electric Vehicle Service Equipment Tester is patented technology that is proprietarily sole source designed, developed, and manufactured by TESCO. There are no other brands of testers available for purchase and the DC Fast Charge Electric Vehicle Service Equipment Tester from TESCO is designed to be able to test all EVCS stations. Purchasing concurs with the non-competitive justification for this procurement.
