Approve Program Supplement Agreement No. F161 to Master Agreement No. 08-5954F15 with the State of California Department of Transportation, to provide $230,000 in federal Community Project Funding/Congressionally Directed Spending funds toward the $260,000 costs for the Preliminary Engineering phase for the Unincorporated Fontana Safe Routes to School Project.

FINANCIAL IMPACT

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The total estimated cost for the Preliminary Engineering (PE) phase of work for an Unincorporated Fontana Safe Routes to School Project (Project) is $260,000. The Project is funded by federal Community Project Funding/Congressionally Directed Spending (CPFCDS) funds of $230,000 administered by the State of California Department of Transportation (Caltrans) and the required local match of $30,000 is funded with Gas Tax revenue. Sufficient appropriation and revenue for the Project is included in the Department of Public Works (Department) 2023-24 Road Operations budget (6650002000 20H15254) and will be included in future recommended budgets, as needed.

 

BACKGROUND INFORMATION

The Project consists of sidewalk construction, sidewalk gap filling, Americans with Disabilities Act curb ramp updates and ladder-style crosswalk markings along Randall Avenue, from Beech Avenue east to Poplar Avenue, in the Fontana area. The Project’s pedestrian improvements run south of two elementary schools, Beech Avenue Elementary School and West Randall Elementary School, and was selected by the Department to solicit federal earmark requests after passage of the federal Infrastructure Investment and Jobs Act (IIJA) was signed into law in November 2021. The law established the CPFCDS program, which allows members of Congress to select specific community projects as part of the annual appropriations process. Congresswoman Norma Torres, representing California District 35, requested $1,500,000 in CPFCDS funds to construct the Project. The request was approved with funding included in the Consolidated Appropriations Act of 2023. The initial allocation of PE funds will be used to design pedestrian improvements along Randall Avenue.

 

In accordance with Master Agreement No. 08-5954F15, approval of a Program Supplement Agreement is required for each specific Project and prior to the County invoicing for reimbursement of costs associated with the Project. The Program Supplement Agreement establishes special covenants as a condition for the local agency to receive federal aid through the State for a designated project. The Program Supplement Agreement also identifies the type of funds available for reimbursement.

 

The item meets the County and the Chief Executive Officer’s goals and objectives by working with Caltrans to ensure that the necessary agreements are processed in accordance with Caltrans guidelines to receive federal funds as reimbursement for PE costs of the Project.
