RECOMMENDATION(S)
Recommendation
1. Find that the Food Court Rehabilitation Project at Prado Regional Park is exempt under the California Environmental Quality Act, Title 14 of the California Code of Regulations Section 15301(a)(d), Class 1, Existing Facilities.
2. Approve Grant Contract (Grant Award Agreement No. B-23-CP-CA-0242) with the United States Department of Housing and Urban Development, for the Food Court Rehabilitation Project at Prado Regional Park, in an amount not to exceed $2,280,000, with a required completion date of August 31, 2031.
3. Authorize the Director of the Regional Parks Department to execute the Grant Contract (Grant Award Agreement No. B-23-CP-CA-0242), and all other related grant documents, including any subsequent non-substantive amendments, with the United States Department of Housing and Urban Development, for the Food Court Rehabilitation Project at Prado Regional Park.
4. Direct the Director of the Regional Parks Department to submit the executed Grant Contract (Grant Award Agreement No. B-23-CP-CA-0242) and any subsequent non-substantive amendments to the Clerk of the Board of Supervisors within 30 days following execution.
5. Approve Capital Improvement Program Project No. 24-041 for the Food Court Rehabilitation Project at Prado Regional Park, in the amount of $2,280,000.
6. Authorize the Auditor-Controller/Treasurer/Tax Collector to post budget adjustments for 2023-24 in the amount of $2,280,000, as detailed in the Financial Impact section, for the Food Court Rehabilitation Project at Prado Regional Park (Four votes required).
7. Direct the Clerk of the Board of Supervisors to file and post the Revised Notice of Exemption.

Approval of this Grant Contract (Grant Award Agreement No. B-23-CP-CA-0242) (Agreement) will not result in the use of Discretionary General Funding (Net County Cost). If approved, this grant award will fund the Food Court Rehabilitation Project (Project) at Prado Regional Park (Park), otherwise known as the snack bar building, in an amount not to exceed $2,280,000. This award does not require any matching funds. All expenditures are fully reimbursable up to $2,280,000. The appropriation and revenue adjustments recommended are as follows:

BACKGROUND INFORMATION
The United States Department of Housing and Urban Development (HUD)’s Office of Community Planning and Development, Congressional Grants Division is responsible for the administration of congressionally directed spending under the Economic Development Initiative - Community Project Funding (CPF). CPF grants provide investment in a wide variety of projects such as housing, homelessness prevention, workforce training, public facilities, parks, resilience planning and other critical infrastructure and services. The Regional Parks Department (Department) submitted a request to Congresswoman Norma Torres’s office for the Project.
On March 2, 2023, the Department received notification from the CPF administration stating that the Project had been funded pending execution of the Agreement. Approval of this item will allow the Department to move forward with execution of the Agreement and starting the Project, subject to the conditions and confirmation that all federal requirements, including, but not limited to, environmental analysis and review, labor, reporting, procurement and contracting have been met.
The Project will consist of assessment and renovation/replacement of the existing snack bar and restroom building to provide accessibility to local residents and visitors to enjoy the outdoors safely. In addition, park patrons will be able to obtain food, water, camping supplies, as well as address personal needs at this building while visiting the park.
Staff from Project and Facilities Management Department (PFMD) has reviewed the Project and determined that a categorical exemption exists in accordance with Project Environmental Quality Act (CEQA) Guidelines, Section 15301, Class 1, Subsection (a) Interior or exterior alterations involving such things as interior partitions, plumbing, and electrical conveyances and Subsection (d) restoration or rehabilitation of deteriorated or damaged facilities to meet current standards of public health and safety. As evidenced by the Notice of Exemption, the renovation of the snack bar and restrooms is consistent with the Class 1 exemption and therefore will not have a significant environmental impact. On June 26, 2023, PFMD filed a preliminary Notice of Exemption with the Clerk of the Board of Supervisors. PFMD recommends the Board of Supervisors (Board) find the Project exempt and direct the Clerk of the Board to file a revised Notice of Exemption to include the project number. No additional CEQA review is required at this time.
The Project aligns with the County and the Chief Executive Officer’s goals and objectives to promote the countywide vision and ensures the development of a well-planned, balanced, and sustainable County through the replacement of the snack bar for the public’s use and enjoyment.
PROCUREMENT
Upon approval of the Project, PFMD will determine whether the design and construction services may be procured through the use of an existing Board-approved Consultant Services Contract for design and a Job Order Contract (JOC) for construction, or if not applicable under a JOC, a competitive selection process following local and federal procurement and California Public Contract Code requirements will be conducted for construction.
