RECOMMENDATION(S)
Recommendation
1. Approve non-financial Long-Term Food, Feed and Cosmetics Information Sharing Agreement with the Food and Drug Administration for Non-Public Food and Cosmetic Regulatory, Public Heath, and Safety Information, for the period of August 20, 2024 through June 30, 2029.
2. Authorize the Chair of the Board of Supervisors, Chief Executive Officer, or Director of the Department of Public Health to execute and submit any subsequent non-substantive amendments to the Long-Term Food, Feed and Cosmetics Information Sharing Agreement, on behalf of the County, subject to review by County Counsel.
3. Direct the Director of the Department of Public Health to transmit all non-substantive amendments in relation to the Long-Term Food, Feed and Cosmetics Information Sharing Agreement to the Clerk of the Board of Supervisors within 30 days of execution.

BACKGROUND INFORMATION
The Federal Food and Drug Administration (FDA) requires the Department of Public Health (DPH) to enter into a non-financial Long-Term Food, Feed and Cosmetics Information Sharing Agreement (Agreement) to receive or send non-public information from the FDA. Under this Agreement, information related to adverse events is shared with state and local agencies responsible for public health oversight of products, such as dietary supplements and cosmetics, as well as product testing laboratories. In an emergency such as a foodborne outbreak, recall, or a report of a suspect product in the supply chain, DPH must disseminate messaging to the public as quickly as possible. Under this five-year Agreement the exchange of information can provide the quick response needed.
DPH has received non-public information from the FDA since 2019. Approval of the recommended Agreement will continue the regulatory and enforcement cooperation between the FDA and DPH. The continued collaboration between both agencies will provide protection and promote the health of County residents.
