RECOMMENDATION(S)
Recommendation
1. Approve Contract with the San Antonio Heights Association to provide funding for the refurbishment costs of the San Antonio Heights Christmas star, for the period December 5, 2023, through September 16, 2026, reallocating $56,893 in remaining funds previously awarded under Contract No. 22-1225, in the not-to-exceed amount of $56,893.
2. Approve Contract with the Fontana Unified School District to contribute funding towards the cost of renaming Randall Pepper Elementary School, a school in the Fontana Unified School District, to O’Day Short Elementary School and to support initiatives focused on diversity, in the not-to-exceed amount of $50,000, for the period of October 22, 2024, through October 21, 2026.
3. Approve Contract with the West Valley Water District to contribute funding towards their Safeguarding Fontana Through Fire Hydrant Retrofit Project, in the not-to-exceed amount of $100,000, for the period of October 22, 2024, through October 21, 2025, and waive the requirement in County Policy 05-10 for a financial matching contribution of at least 25% from the West Valley Water District.
4. Approve contract with the Foothill Family Shelter, Inc. to provide funding for their housing and shelter programs, in the not-to-exceed amount of $10,000, for the period of October 22, 2024, through October 21, 2025.
5. Approve Contract with the Upland Chamber of Commerce to continue to support their efforts and promote community involvement in the City of Upland, in the not-to-exceed amount of $25,000, for the period of October 22, 2024, through October 21, 2025.
6. Approve Contract with Ontario Pro Soccer LLC dba Empire Strykers to promote the County with an additional “San Bernardino County Night” at one of the home games and through the acquisition of additional game tickets to be distributed to residents of the Fourth District, with priority given to youth, for the Ontario Pro Soccer LLC dba Empire Strykers for the 2024-2025 Major Arena Soccer League season, for a total of $10,000, for the period of October 22, 2024, through October 21, 2025.
7. Approve an allocation totaling $2,250, $1,750 from the Second District Priorities Program and $500 from the Fourth District Priorities Program, for administrative costs related to Recommendation Nos. 4, 5, and 6.

FINANCIAL IMPACT
Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost). On September 21, 2021 (Item No. 18), November 16, 2021 (Item No. 33), February 6, 2024 (Item No. 61), and June 11 (Item No. 110) the Board of Supervisors (Board) approved an allocation of $4 million, $7 million, $6 million, and $3 million respectively, to the Board Discretionary Fund - District Specific Priorities Program (Priorities Program), for each of the five supervisorial districts for projects that meet a public purpose, and provide services to citizens that promote health, safety, economic well-being, and other public services that enhance quality of life and meet the needs of County residents. On an annual basis, unspent appropriations for discretionary funding will be carried over into the subsequent year’s budget.
Recommendation No. 1 will be funded using reallocated Second District Priorities Program funds originally allocated to Contract No. 22-1225, which was approved by the Board on December 6, 2022 (Item No. 17). Recommendations Nos. 2, 3, 4, and 5 will also be funded by the Second District’s Priorities Program budget. Recommendation No. 6 will be funded by the Fourth District’s Priorities Program budget.
Per County Policy 05-10, for Board discretionary funding allocations that are under $50,000, an additional 5% rate shall be applied to the cost of each allocation of Board discretionary funds to third-party entities which will be distributed to the department/agency that administers the payment of Board discretionary fund allocations to cover staffing and other administrative costs. The County Administrative Office (CAO) - Finance and Administration administers all payments of Board discretionary fund allocations. The 5% allocation to the CAO - Finance and Administration totaling $2,250 ($1,750 from the Second District Priorities Program and $500 from the Fourth District Priorities Program) for administrative costs related to Recommendation Nos. 4, 5 and 6 will be processed once the Board discretionary payment is made to each third-party entity.
BACKGROUND INFORMATION
Priorities Program projects help promote the vision of a complete County by recognizing the unique traits of each Supervisorial District and, thereby, allow individual Board Districts to work with community partners through County services and contractual agreements to identify programs, projects, and initiatives that support the vision, meet a public purpose and provide services to residents that promote health, safety, economic well-being, education, recreation, and other public services that enhance quality of life, and meet the needs of the County’s residents. Projects under the District Specific Priorities Program are based on District Supervisor discretion and are presented by the Chief Executive Officer (CEO) for Board approval.
On December 6, 2022 (Item No. 17), the Board approved Contract No. 22-1225 with the San Antonio Heights Association for the period of December 6, 2022, through December 5, 2023, to provide funding in an amount not-to-exceed $56,893, to assist with the cost of refurbishing the San Antonio Heights Christmas star, which was damaged by winds, fire, and theft. Due to delays experienced in trying to obtain the required permits, the San Antonio Heights Association has not been able to start any work on refurbishing the star. Recommendation No. 1 will approve a new contract with the San Antonio Heights Association, reallocating $56,893 previously approved under Contract No. 22-1225, and allowing additional time to complete all necessary work. To ensure all expenses made to date by San Antonio Heights Association are allowable, the District is requesting approval of this new contract retroactively effective December 5, 2023. Approval of this contract continues to assist the Second District Supervisor with the public purpose of providing for the social service needs of county residents by continuing the mission of community spirit which the San Antonio Heights Christmas star provides. No additional funding in excess of the $56,893, previously allocated under Contract No. 22-1225, is being allocated to San Antonio Heights Association under this new contract.
Recommendation No. 2 will assist the Second District Supervisor in supporting County residents by providing funding towards the cost of renaming Randall Pepper Elementary School, a school in the Fontana Unified School District, to O’Day Short Elementary School. In December 1945, O'Day Short, his wife, and their two children, were tragically murdered in a racially motivated attack. Their only "crime" was moving to a neighborhood that refused to accept them. The current location of Randall Pepper Elementary School is on the very site where this tragedy occurred, making the proposed name change to O'Day Short Elementary School especially significant. Additionally, funding will support diversity initiatives, including the creation of an age-appropriate curriculum about Fontana’s history, with lesson plans that highlight the diverse cultural, economic, political, and social experiences of Fontana residents from the 1880s to the 2000s. Initiatives will include guest speakers, historical artifacts, interactive presentations, and activities to enrich students' understanding of the region's history. This project serves the public purpose of providing for the social, educational, and economic needs of County residents.
Recommendation No. 3 assists the Second District Supervisor with the public purpose of providing for the health, safety, and emergency response needs of County residents by providing funding to West Valley Water District (WVWD) to assist with the costs of their Safeguarding Fontana Through Fire Hydrant Retrofit Project (Retrofit Project). This project involves constructing new fire hydrants and retrofitting existing fire hydrants in South Fontana. The recommendation also waives County Policy 05-10, allowing WVWD to fulfill the 25% matching contribution requirement through personnel and equipment provided during the Retrofit Project, in lieu of a financial matching contribution of at least 25%. The Retrofit Project aims to ensure that homes are within the recommended distances from fire hydrants for optimal fire protection and to upgrade hydrants to current WVWD standards.
Recommendation No. 4 assists the Second District Supervisor in supporting County residents by providing funding to the Foothill Family Shelter, Inc. to assist with the costs of its housing and shelter programs. For over 40 years, Foothill Family Shelter, Inc. has provided transitional housing and walk-in services such as food, diapers, and hygiene products to low-income and homeless families from the cities of Upland, Ontario, Montclair, Rancho Cucamonga, Claremont, and Pomona. Approval of this contract serves the public purpose of providing for the social service, health, and housing needs of county residents.
The Upland Chamber of Commerce (Upland Chamber) was established in 1963 to advocate and create a networking opportunity for businesspeople within the Upland community. Recommendation No. 5 assists the Second District Supervisor with meeting the economic and social well-being needs of County residents by providing funding to the Upland Chamber to continue to support their efforts and promote community involvement in the City of Upland. County residents will be served by the Upland Chamber’s continuing efforts to promote the continuous improvement of the common good and the quality of life in the community through the pursuit of new business; the cultural, social, and economic education of citizens in the City of Upland; and by providing accurate and timely assistance to the business community.
Recommendation No. 6 assists the Fourth District Supervisor with the public purpose of providing for the health, economic, recreational, and social service needs of residents by promoting the County with an additional “San Bernardino County Night” at one of the home games and through the acquisition of additional game tickets for the Ontario Pro Soccer LLC dba Empire Strykers for the 2024-2025 Major Arena Soccer League season. Tickets are to be distributed to residents of the Fourth District with priority given to youth and distribution done in partnership with local school districts.
Per County Policy 05-10, Board discretionary funding allocations that are under $50,000, a five percent (5%) rate shall be applied to the cost of each allocation of Board discretionary funds to third-party entities and will be distributed to the department/agency that administers the payment of Board discretionary fund allocations to cover staffing and other administrative costs. The County Administrative Office (CAO) - Finance and Administration administers all payments of Board discretionary fund allocations. Recommendation No. 7. approves a 5% allocation to the CAO - Finance and Administration for administrative costs related to Recommendation Nos. 4, 5, and 6, $1,250 for Upland Chamber of Commerce, $500 for Foothill Family Shelter, Inc, and $500 for Ontario Pro Soccer LLC dba Empire Strykers.
Under the Board Discretionary Fund Priority Program contract terms, the CEO, at the direction of the identified District Supervisor, may extend the term of the recommended contracts in writing, under the following conditions:
a. In aggregate all extensions do not exceed 12 calendar months;
b. Is specifically requested by the contractor;
c. Will not change the project goals or scope of services;
d. Is in the best interest of the County and contractor in performing the scope of services under the contract; and
e. Does not alter the amount of compensation under the contract.
Board discretionary funding allocations under the Priorities Program with community partners must be for projects or services of $10,000 or more as described in County Policy 05-10. Additionally, contracts that include non-profit organizations, government entities, or educational institutions are non-competitive. Contracts with community partners that include for-profit organizations are to be processed according to existing County procurement policies. Contracts with other government agencies or for-profit organizations require a matching contribution of at least 25% of the proposed projects and shall be paid on a lump-sum basis or under other terms as approved by the Board.
