RECOMMENDATION(S)
Recommendation
Acting as the governing body of the San Bernardino County Flood Control District, adopt Resolution that:
1. Makes findings, initiates, and supports a proposal to the San Bernardino County Committee on School District Organization to reorganize the Etiwanda School District and Alta Loma School District boundaries by transferring approximately 1,000 acres of territory currently owned by the San Bernardino County Flood Control District and located within the Etiwanda School District boundaries to be located within the Alta Loma School District boundaries;
2. Requests that the San Bernardino County Committee on School District Organization take various actions on this reorganization proposal, including a review of the proposal, holding a public hearing, and taking any other steps called for under applicable law, including the California Education Code and the California Environmental Quality Act;
3. Authorizes certain positions to serve as the San Bernardino County Flood Control District representative and official agent in all matters pertaining to the reorganization proposal, including the preparation of any required documents, and to coordinate with the San Bernardino County Committee on School District Organization and State education agencies, as required; and
4. Directs the Clerk of the Board of Supervisors to transmit copies of this Resolution to the San Bernardino County Committee on School District Organization within 30 days of its passage and adoption.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). Any costs associated the proposal to the San Bernardino County Committee on School District Organization will be reimbursed by Rancho Eitwanda, LLC (Rancho Etiwanda) pursuant to a Cost Reimbursement Agreement (Contract No. 25-905) approved by the Board of Supervisors (Board) for the San Bernardino County Flood Control District (District) on November 18, 2025 (Item No. 101).
BACKGROUND INFORMATION
California Education Code (including but not limited to Sections 35500 et seq., 35700 et seq., and 35720-35724) provides that proposals for school district reorganization (such as territory transfer or other boundary/status changes) may be initiated by petition or by a resolution adopted by a local agency with jurisdiction over all or part of the territory involved. These codes further allow the Board to request the San Bernardino County Committee on School District Organization to hold a public hearing on this proposal to transfer territory from Etiwanda School District to Alta Loma School District.
On December 3, 2024 (Item No. 58), the Board approved Purchase and Sale Agreement No. 24-1171 with Rancho Etiwanda for 1,252.21 acres of vacant surplus land owned by the District within the Etiwanda Heights Neighborhood and Conservation Plan area, in the City of Rancho Cucamonga (Property). The terms of the Purchase and Sale Agreement allow Rancho Etiwanda to acquire the Property, in phases, during a five-year term and an optional five-year extended term. Property acquisition within the first five-year term will result in total consideration of $93,000,000 plus interest, plus the additional potential profit participation consideration of up to $20,000,000. All proceeds from the sale of the land will be used to further express the District’s purpose of protecting life and property and for water conservation. As of the date of this item, Rancho Etiwanda has not acquired the Property and the District is still the record owner of the Property.
Roughly 250 acres of the 1,252.21 acres are located within the Alta Loma School District. Rancho Etiwanda has proposed to the District a school district boundary change that would affect the Property and boundaries of Alta Loma School District and Etiwanda School District.
This item recommends adoption of a resolution that would initiate and support a District proposal to the San Bernardino County Committee on School District Organization to reorganize the Etiwanda School District and Alta Loma School District boundaries by transferring approximately 1,000 acres of territory currently owned by the San Bernardino County Flood Control District and within the Etiwanda School District boundaries to be located within the Alta Loma School District boundaries for the following reasons: 1) school districts may be able to achieve administrative savings from the transfer of the territory of approximately 1,000 acres from Etiwanda School District into the territory of the Alta Loma School District; 2) reorganization of these school districts may be able to better serve the students of the existing districts, with the ability to provide enhanced educational and academic programs, and help to implement more efficient use of taxpayer dollars in educating students; and 3) it may be in the best interest of the students, parents, and residents of the District to propose a reorganization consisting of the transfer of approximately 1,000 acres in territory as set forth in the attached Exhibit “A,” of the resolution from Etiwanda School District to Alta Loma School District.
Adoption of the resolution would authorize the submission of a reorganization proposal to the San Bernardino County Committee on School District Organization to reorganize the Etiwanda School District and Alta Loma School District by transferring territory from Etiwanda School District to Alta Loma School District. The reorganization proposal for a boundary change would cover the remaining 1,000 acres of the Property, currently located within the boundaries of the Etiwanda School District. Adoption of resolution authorizes the Second District Supervisor, the Chief Executive Officer, the Assistant Executive Officer or the Chief Flood Control Engineer, to serve as its representative and official agent in all matters pertaining to the reorganization proposal, including the preparation of any required documents, and to coordinate with the San Bernardino County Committee on School District Organization and State education agencies, as required; and directs the Clerk of the Board of Supervisors to transmit copies of the resolution to the San Bernardino County Committee on School District Organization within 30 days of its passage and adoption.
