Recommendation
Approve Amendment No. 2 to Grant Agreement No. 24-328 with the State Coastal Conservancy for the Santa Ana River Trail Phase IV-A, to allow for full advance disbursement of grant funds, with no changes to the term of April 23, 2024, through January 31, 2048, or the amount of $6,800,000.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). $6,800,000 is funded by the State Coastal Conservancy. There is no cost associated with this amendment, only the acceptance of advanced funding.
BACKGROUND INFORMATION
In 2006, California voters passed the Safe Drinking Water, Water Quality and Supply, Flood Control, River and Coastal Protection Act of 2006 (Proposition 84). This act authorized $45 million in general obligation bonds for the entire Santa Ana River Trail (SART) (which crosses through three counties). The Coastal Conservancy was authorized by the State Resources Agency to administer these funds.
On April 23, 2024 (Item No. 55), the Board of Supervisors (Board) approved Agreement No. 24-328 (State Agreement No. 23-130) (Agreement) in the amount of $6,800,000 for the construction of SART Phase IV-A from California Street to Orange Street in Redlands, with a required completion date of January 31, 2026 and a termination date of January 31, 2046.
On September 9, 2025 (Item No. 62), the Board approved Amendment No. 1 to the Agreement, to amend the route of the SART to be changed due to utility and mitigation concerns in the original path. The amendment extended the completion date to January 31, 2028 providing the Regional Parks Department (Department) with additional time to complete the project and extended the termination of the agreement to January 31, 2048.
Amendment No. 2 will allow the Department to receive funds in advance, ensuring the timely availability of funding for eligible project activities. In turn, the Department will be able to reimburse County departments for allowable expenditures associated with completed work, lessening the delays associated with submitting reimbursement requests and awaiting payment processing by the State.
This action meets the County’s and Chief Executive Officer’s goals and objectives of operating in a fiscally-responsible and business-like manner by seeking grant funding for projects; ensuring development of a well-planned, balanced, and sustainable County by constructing facilities that encourage walking and biking; and providing for the safety, health and social services needs of County residents by providing opportunities for healthy activities with construction of the SART.
