RECOMMENDATION(S)
Recommendation
1. Accept Grant Award (Award No. 15PBJA-25-GG-03553-JAGX) from the United States Department of Justice, Office of Justice Programs, Bureau of Justice Assistance, under the FY 2025 Edward Byrne Memorial Justice Assistance Grant Program, in the amount of $823,030, for the period of October 1, 2024 through September 30, 2028.
2. Authorize the County Chief Financial Officer, the Chair of the Law and Justice Group, or the assigned grant administrator, as required by the Edward Byrne Memorial Justice Assistance Grant Program, to electronically accept the grant in the JustGrants system and submit all required documents and forms for administration of the grant.
3. Rescind Interlocal Agreement No. 26-299 for the FY 2025 Edward Byrne Memorial Justice Assistance Grant Program with the Towns of Apple Valley and Yucca Valley, and the Cities of Adelanto, Barstow, Chino, Colton, Fontana, Hesperia, Highland, Montclair, Ontario, Rancho Cucamonga, Redlands, Rialto, San Bernardino, Upland, Victorville, and Yucaipa.
4. Approve Interlocal Agreement, as required by the FY 2025 Edward Byrne Memorial Justice Assistance Grant Program, with the Town of Apple Valley and the Cities of Adelanto, Barstow, Chino, Colton, Fontana, Hesperia, Highland, Montclair, Ontario, Rancho Cucamonga, Redlands, Rialto, San Bernardino, Upland, Victorville, and Yucaipa.
5. Approve individual grant sub-award Agreements, as required by the Edward Byrne Memorial Justice Assistance Grant Program, with the following 17 participating jurisdictions, for the period of October 1, 2024 through September 30, 2028:

6. Authorize the Chair of the Law and Justice Group to execute the individual grant sub-award Agreements with the 17 participating jurisdictions identified in Recommendation No. 4, and any other non-substantive amendments, for the FY 2025 Edward Byrne Memorial Justice Assistance Grant Program, for the period of October 1, 2024 through September 30, 2028.
7. Direct the County Chief Financial Officer, the Chair of the Law and Justice Group, or the assigned grant administrator to transmit the grant sub-award Agreements and any related non-substantial amendments to the Clerk of the Board of Supervisors within 30 days of execution.
8. Authorize the Auditor-Controller/Treasurer/Tax Collector to post the adjustments to the Law and Justice Group 2026-27 budget as detailed in the Financial Impact section (Four votes required).

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). No matching funds are required for the FY 2025 Edward Byrne Memorial Justice Assistance Grant Program. Following submission of the grant application, the Town of Yucca Valley elected not to participate in the program. Accordingly, San Bernardino County will pass through $649,249 to the 17 remaining subrecipient agencies. The County will retain a total of $173,781, $132,630 for specific County projects and $41,151 for grant administration. The Law and Justice Group (L&JG) requests the Auditor-Controller/Treasurer/Tax Collector post the necessary adjustments to the 2026-27 budget.

BACKGROUND INFORMATION
The United States Department of Justice (DOJ), Office of Justice Programs, Bureau of Justice Assistance announces the availability of grant funds to state and local units of government through the Edward Byrne Memorial Justice Assistance Grant Program (JAG) Program annually. San Bernardino County has participated in the JAG Program since 2005. This program provides funding to state and local governments for support of a broad range of activities intended to prevent and control crime and improve the criminal justice system. Distribution of funds by the federal government is calculated using a formula, which considers both population and crime statistics. Awards are subject to the availability of appropriated funds.
On April 21, 2026 (Item No. 23), the Board of Supervisors (Board) approved submission of a grant application to the DOJ in the amount of $823,030 for the FY 2025 Edward Byrne Memorial Justice Assistance Grant Program and approved the Interlocal Agreement required for the joint application. Subsequent to Board approval, the Town of Yucca Valley notified the County that it elected not to participate in the FY 2025 JAG Program. The County notified the DOJ by submitting the Town's letter declining participation and revised budget detail worksheets reflecting the remaining participating jurisdictions. As reflected in the revised budget submitted to the DOJ, the $10,346 originally intended for the Town of Yucca Valley was reallocated to eligible County law and justice projects.
Pursuant to the grant application requirements, San Bernardino County will enter into grant sub-award Agreements with the Town of Apple Valley and the Cities of Adelanto, Barstow, Chino, Colton, Fontana, Hesperia, Highland, Montclair, Ontario, Rancho Cucamonga, Redlands, Rialto, San Bernardino, Upland, Victorville, and Yucaipa to share the FY 2025 JAG grant. San Bernardino County will serve as the applicant/fiscal agent for administration of the joint funds and will retain a five percent administrative fee for use by the Law and Justice Group to administer the grant over the four-year grant term.
Grant funds will be provided to subrecipient agencies on a reimbursement basis upon submission and approval of eligible expenditures, rather than through advances of grant funds.
The performance period for the FY 2025 JAG Program is retroactive from October 1, 2024, through September 30, 2028. This period is consistent with the JAG Program’s funding cycle, as the application submission deadline occurred after the start of the performance period. The County Law and Justice Group submitted the grant application on April 21, 2026.
