RECOMMENDATION(S)

Recommendation

1.                     Approve Amendment No. 1 to Agreement No. 23-416 with Verdantas, Inc., for geotechnical materials testing, and inspection services, changing the contractor’s name from Leighton Consulting, Inc., to Verdantas, Inc., and increasing the amount by $700,000, from $1,000,000 to $1,700,000, with no change to the term of May 23, 2023, through May 22, 2028.

2.                     Approve Amendment No. 1 to Agreement No. 23-420 with EFI Global, Inc., which amends the existing agreement to incorporate rate sheets that were inadvertently omitted from the original agreement, for environmental consulting services, and increasing the amount by $200,000, from $500,000 to $700,000, with no change to the term of May 23, 2023, through May 22, 2028.

3.                     Approve Amendment No. 1 to Agreement No. 23-353 with Holt Architects, dba Holt Architecture, for architectural services, increasing the amount by $500,000, from $4,000,000 to $4,500,000, with no change to the term of May 23, 2023, through May 22, 2028.

4.                     Approve Amendment No. 1 to Agreement No. 23-387 with Kitchell/CEM, Inc., for construction management services, increasing the amount by $1,600,000, from $4,500,000 to $6,100,000, with no change to the term of May 23, 2023, through May 22, 2028.

5.                     Approve Amendment No. 1 to increase each of the following agreements for Geotechnical Materials Testing Inspection services by $700,000, from $1,000,000 to $1,700,000, with no change to the term of May 23, 2023, through May 22, 2028:

a.                     RMA Group, Agreement No. 23-413

b.                     Ninyo & Moore Geotechnical & Environmental Sciences Consultants, Agreement No. 23-414

6.                     Approve Amendment No. 1 to Agreement No. 23-418 with The Converse Professional Group, for environmental consulting services, increasing the amount by $200,000, from $500,000 to $700,000, with no change to the term of May 23, 2023, through May 22, 2028.

7.                     Approve Amendment No. 3 to Agreement No. 23-419 with Terracon Consultants, Inc., for environmental consulting services, increasing the amount by $200,000, from $780,000 to $980,000, with no change to the term of May 23, 2023, through May 22, 2028.

FINANCIAL IMPACT

Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost). The on-call professional services provided under these agreements are fully funded within the individual project budgets as part of the Capital Improvement Program (CIP), as approved by the Board of Supervisors (Board). The proposed amendments increase total contract authority by $6,200,000 across the identified agreements.

 

BACKGROUND INFORMATION

Since its inception in July 2005, the on-call consultant process has provided expert architectural, engineering, testing, mechanical/electrical/plumbing engineering, and construction management services for numerous CIP projects. The availability of on-call services has allowed the Project and Facilities Management Department (PFMD) to accelerate the selection of design, engineering, or construction related professional services, resulting in valuable savings of time and cost in the overall design/construction timeline. The on-call consultant process has improved the delivery of much-needed projects. Operationally, the on-call consultant process has been integral in helping PFMD meet San Bernardino County (County) and Chief Executive Officer’s goals and objectives to improve County government operations and operate in a fiscally responsible and business-like manner by providing savings of time and cost in the overall design and construction timeline of projects.

 

On May 23, 2023 (Item No. 50), as the result of Request for Proposals Nos. ANE223-ANE2C-4789 and ANE223-ANE2C-4786, the Board approved 83 on-call professional services agreements, which included the contractors identified in Recommendation Nos. 1 through 8.

 

On May 6, 2025 (Item No. 25), the Board approved Amendment No. 1 to multiple agreements supporting Department of Behavioral Health (DBH) projects. This included increasing Agreement No. 23-419 with Terracon Consultants, Inc. by $250,000, from $500,000 to $750,000, for the continued provision of environmental consulting services across multiple DBH facilities, and increasing Agreement No. 23-417 with Terracon Consultants, Inc. by $250,000, from $1,000,000 to $1,250,000, for continued geotechnical material testing.

 

On November 4, 2025 (Item No. 29), the Board approved Amendment No. 2 to Agreement No. 23-419 with Terracon Consultants, Inc. further increasing the agreement amount by $30,000, from $750,000 to $780,000.

 

Approval of Amendment No. 1 to Agreement No. 23-416 will update the entity’s name from Leighton Consulting, Inc. to the new consultant’s name of Verdantas, Inc., so the consultant may continue to provide on-call professional geotechnical material testing inspection services to the County and increase the total contract amount by $700,000, from $1,000,000 to $1,700,000, to support the continued provision for active and upcoming County projects. The requested increase is necessary as the current agreement authority is nearing exhaustion due to sustained project activity and expanded regulatory, inspection, and documentation requirements associated with construction and infrastructure projects. These services are critical to ensuring compliance with applicable standards and maintaining project schedules across multiple County facilities during the remaining term of the agreement.

 

Approval of Amendment No. 1 to the Agreement No. 23-420 with EFI Global, Inc., will amend the original agreement to incorporate the original remaining rate sheets that were submitted as part of their original proposal, but were inadvertently omitted at the time of execution. The inclusion of these rate sheets provides a comprehensive and transparent schedule of rates applicable to specific tasks and services performed under the agreement. Amendment No. 1 also increases the total amount by $200,000, from $500,000 to $700,000, to support the continued provision for active and upcoming County projects. The requested increase is necessary as the current agreement authority is nearing exhaustion due to sustained project activity and expanded regulatory, inspection, and documentation requirements associated with construction and infrastructure projects. These services are critical to ensuring compliance with applicable standards and maintaining project schedules across multiple County facilities during the remaining term of the agreement.

 

Approval of Amendment No. 1 to Agreement No. 23-353 with Holt Architecture, Inc. will increase the total amount by $500,000, from $4,000,000 to $4,500,000, to allow the firm to continue providing architectural services for active and upcoming San Bernardino County Fire Protection District (County Fire) projects across multiple County Fire facilities.

 

Approval of Amendment No. 1 to Agreement No. 23-387 with Kitchell/CEM, Inc. will increase the total contract amount by $1,600,000, from $4,500,000 to $6,100,000, to allow the firm to continue providing construction management services for active projects across multiple County facilities including County Fire, County Counsel, Sheriff/Coroner/Public Administrator (Sheriff), Department of Public Health (DPH), County Government Center, and various other facilities.

 

Approval of Amendment No. 1 to Agreement Nos. 23-416, 23-413, 23-414, and 23-415 with Verdantas, Inc., RMA Group, Ninyo & Moore Geotechnical & Environmental Sciences Consultants, and Geocon West, Inc., respectively, will increase each total contract amount by $700,000, from $1,000,000 to $1,700,000, to allow firms to continue providing geotechnical materials testing and inspection services for active projects across multiple County facilities including County Fire, County Counsel, Sheriff, DPH, County Government Center, and various other facilities.

 

Approval of Amendment No. 1 to Agreement No. 23-418 with The Converse Professional Group, to increase the total amount by $200,000, from $500,000 to $700,000, to allow the firm to continue providing environmental consulting services for active projects across multiple County facilities including County Fire, County Counsel, Sheriff, DPH, County Government Center, and various other facilities.

 

Approval of Amendment No. 3 to the Agreement No. 23-419 with Terracon Consultants, Inc. will increase the total contract amount by $200,000, from $780,000 to $980,000, to allow the firm to continue providing environmental consulting services for active projects across multiple County facilities including Department of Behavioral health, County Fire, Sheriff, DPH, and various other facilities.

 

Approval of Amendment No. 2 to Agreement No. 23-417 with Terracon Consultants, Inc. will increase the total amount by $700,000, from $1,250,000 to $1,950,000, to allow the firm to continue providing geotechnical, materials testing, and inspection services for active projects across multiple County facilities, including DBH, County Fire, Sheriff, DPH, and various other facilities.

 

The above requested amendments are necessary at this time as prior approved agreement limits are reaching their maximum threshold. The service providers are currently engaged in existing County projects, or upcoming projects, and if the agreement limits are not increased it will impact the County’s ability to proceed with these projects and may delay completion. Many of these service providers are extremely familiar with County procedures and special needs and a loss of them would have a negative impact on ongoing construction and design.
