Recommendation
Acting as the governing body of the San Bernardino County Fire Protection District, approve Amendment No. 3 to Revenue Agreement No. 22-390 with the City of Upland, for fire and life safety protection services provided at City-sponsored events, to revise the personnel and equipment rates for July 1, 2026, through June 30, 2027, with the rates automatically adjusting July 1 of each year based on the San Bernardino County Fire Protection District’s Board-approved fees, unless modified by a subsequent amendment, with no change to the agreement term of May 24, 2022, through June 30, 2030, and all other terms and conditions remaining in effect.

FINANCIAL IMPACT
Approval of Amendment No. 3 (Amendment) to Revenue Agreement No. 22-390 (Agreement) will not result in the use of Discretionary General Funding (Net County Cost). The City of Upland (City) will reimburse the San Bernardino County Fire Protection District (SBCFPD) for fire and life safety protection services provided at City-sponsored events based on the hourly personnel and equipment rates set forth in the Amendment.
The total revenue generated under the Agreement will vary depending on the number, size, duration, and staffing and equipment needs of City-sponsored events. Services will be billed to the City at the updated hourly rates as identified in the Amendment and the revenue from this Amendment will provide full cost recovery for SBCFPD. Sufficient appropriation and revenue for this Amendment are included in SBCFPD’s 2026-27 budget and will be included in future recommended budgets.
BACKGROUND INFORMATION
The City hosts public events throughout the year, including its annual Lemon Festival. Events of this nature may require onsite fire and life safety resources to help protect attendees, vendors, City staff, and the surrounding community. The City contracts with SBCFPD to provide these services when needed for City-sponsored events.
On May 24, 2022 (Item No. 106), SBCFPD’s Board of Directors (Board) approved the Agreement authorizing SBCFPD personnel to provide fire and life safety services for City-sponsored events, for the period of May 24, 2022, through June 30, 2025.
On July 9, 2024 (Item No. 61), the Board approved Amendment No. 1, which updated the personnel and equipment rates for the period of July 1, 2024, through June 30, 2025, with all other agreement terms remaining unchanged.
On May 20, 2025 (Item No. 99), the Board approved Amendment No. 2, which revised the personnel and equipment rates for the period of July 1, 2025, through June 30, 2026, and extended the Agreement term for an additional five years, for a total period of May 24, 2022, through June 30, 2030.
Approval of the Amendment will update the personnel and equipment rates for services provided retroactively from July 1, 2026, through June 30, 2027. The signed Amendment was received on August 18, 2026, and is being presented at this time as this is the first available Board meeting following all required administrative, legal and financial reviews. The rates as shown in the Amendment will update automatically effective July 1 of each year based on SBCFPD’s Board of Directors’ approved fees, unless changed via a new amendment.
Approval of the Amendment will allow the SBCFPD to continue providing fire and life safety protection services at City-sponsored events while ensuring the City reimburses SBCFPD at the updated rates. The Amendment does not change the scope of services or the agreement term. All other terms and conditions of the Agreement remain in effect.
Either party may terminate the Agreement at any time without cause with 30 days’ prior written notice to the other party. All other terms of the Agreement shall remain the same.
