RECOMMENDATION(S)
Recommendation
1. Acting as the governing body of San Bernardino County:
a. Approve a corrective Grant Deed to convey approximately 0.86 acres of vacant land located in the Town of Yucca Valley (Assessor's Parcel Number 0595-171-04-0000) to San Bernardino County Fire Protection District at no cost.
b. Authorize the Director of the Real Estate Services Department to execute any non-substantive documents, including but not limited to disclosures and notices necessary to complete this transaction, subject to County Counsel review.
2. Acting as the governing body of the San Bernardino County Fire Protection District:
a. Approve the acceptance of a corrective Grant Deed for approximately 0.86 acres of vacant land located in the Town of Yucca Valley (Assessor's Parcel Number 0595-171-04-0000).
b. Authorize the Director of the Real Estate Services Department to execute the Certificate of Acceptance for the corrective Grant Deed and any non-substantive documents, including but not limited to disclosures and notices necessary to complete the transaction, subject to County Counsel review.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). There are no costs associated with the corrective Grant Deed for approximately 0.86 acres of vacant land located in the Town of Yucca Valley (Assessor's Parcel Number 0595-171-04-0000) (Property) because San Bernardino County Fire Protection District (SBCFPD) funds were used to purchase the Property, but the title was inadvertently conveyed to San Bernardino County (County). SBCFPD (6100412454) will be responsible for all administrative processing costs associated with the preparation and recording of the corrective Grant Deed. Adequate appropriation is included in the SBCFPD's 2026-27 budget.
BACKGROUND INFORMATION
On April 23, 2024 (Item No. 69), the Board of Directors (Board) of SBCFPD approved a Purchase and Sale Agreement (Contract No. 24-322) (PSA) for the acquisition of the Property as a preferred site for the replacement of Yucca Valley Fire Station #41 and authorized the Director of the Real Estate Services Department (RESD) to execute the Certificate of Acceptance and any non-substantive documents, including but not limited to disclosures and notices necessary to complete the acquisition.
Following the close of escrow on August 15, 2026, pursuant to the PSA and recording of the grant deed, it was discovered that the title to the Property was inadvertently vested in the County rather than SBCFPD, the intended grantee pursuant to the PSA. To correct the title, this item will authorize the County to convey a corrective Grant Deed for the Property to SBCFPD and will authorize the RESD Director to execute a certificate of acceptance for the corrective Grant Deed on behalf of SBCFPD.
The Property was acquired as a preferred site for the replacement of Fire Station #41, subject to CEQA compliance. On November 18, 2025 (Item No. 97), SBCFPD’s Board adopted the Initial Study/Mitigated Negative Declaration for the replacement fire station (Project), which reviewed the acquisition of the Property for the Project. A Notice of Determination was posted. The corrective Grant Deed does not constitute a project under CEQA, and no further review is required under CEQA.
