RECOMMENDATION(S)
Recommendation
1. Find that approval of Amendment No. 5 to Lease Agreement No. 07-983 with Silver Lakes Association for office space, is an exempt project under the California Environmental Quality Act Guidelines, Section 15301 - Existing Facilities (Class 1).
2. Approve Amendment No. 5 to Lease Agreement No. 07-983, through the Real Estate Services Department’s use of an alternative procedure in lieu of a Formal Request for Proposals, as allowed per County Policy 12-02 - Leasing Privately Owned Real Property for County Use, to:
a. Extend the term of the Lease Agreement for approximately 170 square feet of office space at 27801 Mountain Springs Road in Helendale for five years, for the period of July 1, 2026 through June 30, 2031, following a permitted holdover period of April 1, 2026 through June 30, 2026, at a nominal holdover cost of $0.24, while the parties finalized the amendment.
b. Add one three-year and one five-year option to extend the Lease Agreement term.
c. Adjust the rental rate schedule for the five-year term, from July 1, 2026 through June 30, 2031, in the amount of $5.
d. Increase the total Lease Agreement amount by $5.24, from $17.83 to a new total amount of $23.07.
3. Direct the Real Estate Services Department to file the Notice of Exemption in accordance with the California Environmental Quality Act.

FINANCIAL IMPACT
Approval of this item will not result in use of Discretionary General Funding (Net County Cost). The total cost of Amendment No. 5 (Amendment) to Lease Agreement No. 07-983 (Lease) is $5, which includes a nominal holdover cost of $0.24, for the permitted month-to-month holdover period. The total cost of this five-year Amendment is $5 and will be paid from the Sheriff/ Coroner/ Public Administrator (Sheriff) budget (4430001000). Sufficient appropriation is included in the 2025-2026 Sheriff’s budget and will be included in future recommended budgets. Annual Lease costs are as follows:

BACKGROUND INFORMATION
The recommended Amendment with Silver Lakes Association (Silver Lakes) extends the term of the Lease for an additional five-year period, from July 1, 2026 through June 30, 2031, and adds one three-year and one five-year option to extend the term, adjusts the rental rate schedule, updates standard lease language, and provides for the continued use of approximately 170 square feet of office space located at 27801 Mountain Springs Road in Helendale (Property) as a Sheriff reporting station supporting law enforcement operations in the Helendale area The parties required additional time to finalize lease terms, complete internal review and approval processes, and execute the amendment, resulting in the permitted holdover period from April 1, 2026 through June 30, 2026.
On November 6, 2007 (Item No. 48), the Board of Supervisors (Board) approved the five-year Lease, for the period of October 1, 2007 through September 30, 2012, with two three-year options to extend the term, with Silver Lakes for the Property. In the 19 years since the Lease was originally approved, the Board has approved four amendments that exercised the original two three-year extension options, added two additional three-year extension options, exercised the first of those additional extension options to extend the Lease through March 31, 2026, adjusted the rental rate schedule, and updated standard lease agreement language.

The project to approve the Amendment was reviewed pursuant to the California Environmental Quality Act (CEQA) and determined to be categorically exempt under Section 15301 - Class 1 Existing Facilities because the proposed Lease is to secure property to operate within the existing structure with negligible or no expansion of existing use.

PROCUREMENT
County Policy 12-02 provides that the Board may approve the use of an alternative procedure in lieu of a Formal Request for Proposal (RFP) process whenever the Board determines that compliance with the formal RFP requirements would unreasonably interfere with the financial or programmatic needs of the County, or when the use of an alternative procedure would otherwise be in the best interest of the County.
