RECOMMENDATION(S)
Recommendation
1. Approve Addendum No. 1, issued on August 13, 2026, to the bid documents for the South Fontana Americans with Disabilities Act Ramps Project - Phase II in the South Fontana Area.
2. Award construction Contract to Onyx Paving Company, Inc. in the amount of $1,282,000 for the South Fontana Americans with Disabilities Act Ramps Project - Phase II in the South Fontana Area.
3. Authorize a contingency fund of $128,200 for the South Fontana Americans with Disabilities Act Ramps Project - Phase II in the South Fontana Area.
4. Authorize the Director of the Department of Public Works to approve the expenditure of the contingency fund of $12,820 for verified quantity overruns for this unit priced construction contract.
5. Authorize the Director of the Department of Public Works to order any necessary changes or additions in the work being performed under the contract for a total amount not to exceed $12,820 of the $128,200, pursuant to Public Contract Code section 20142.
6. Authorize the Director of the Department of Public Works to accept the work when 100% complete and execute and file the Notice of Completion.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The South Fontana Americans with Disabilities Act Ramps Project - Phase II in the South Fontana area (Project) is funded with $607,802 of grant revenue from the Community Development Block Grant (CDBG) funds administered by the San Bernardino County Community Development and Housing Department (CDH), with the remaining funds through Senate Bill 1 Road Maintenance and Rehabilitation Account (RMRA) revenues. Sufficient appropriation and revenue are included in the Department of Public Works (Department) 2026-27 Road Operations budget (6650002000 H15027).
BACKGROUND INFORMATION
The Project consists of installing new or reconstructing 59 curb ramps in accordance with current design standards and pursuant to the Americans with Disabilities Act (ADA) guidelines. The construction work will take place at various locations in the unincorporated South Fontana area. Other improvements include replacing cross gutters, signage and road striping as needed. All work for the Project will be done within the existing right-of-way. This Project is Phase II of a multi-phase effort to install new or reconstruct approximately 150 ADA ramps in the South Fontana area.
On March 9, 2022, the Department’s environmental staff reviewed the South Fontana Americans with Disabilities Act Ramps Project, which was planned as a three-phase effort to install or reconstruct approximately 150 ramps. The phases were planned for implementation based on funding availability and right-of-way considerations. Environmental staff determined that the Project was categorically exempt in accordance with the California Environmental Quality Act (CEQA) Guidelines, Title 14 of the California Code of Regulations, Section 15301(c) Class 1, which covers minor alterations to existing streets, sidewalks, and similar facilities with no expansion of use, and Section 15302(c) Class 2, which allows for the replacement or reconstruction of existing structures or facilities on the same site with substantially the same purpose and capacity. Additionally, the acquisition of any necessary rights-of-way applicable to Phase III of the Project is considered administrative in nature, and such action is therefore exempt from CEQA under the common sense exemption in Section 15061(b)(3). The Notice of Exemption (NOE) was filed and posted by the Clerk of the Board on August 21, 2025.
This Project will have a ten percent contingency fund of $128,200 to compensate the contractor for verified quantity overruns, as well as changes in the contract under certain circumstances. Under an established formula based on the contract amount, Public Contract Code section 20142 allows the Board of Supervisors (Board) to authorize the Director of Public Works to order changes in the contract, including for unforeseen conditions or design shortfalls, should they become necessary in the future, for a total amount not to exceed $12,820 of the $128,200 contingency fund.
Following Board approval of this item, construction is anticipated to commence in October of 2026 and be completed by January 2027, with a construction completion date of 60 working days from the date of issuance of the Notice to Proceed for the Project.
PROCUREMENT
On June 30, 2026, the Assistant Executive Officer approved the Project’s plans and specifications, as well as authorized the Director of the Department to advertise the Project for bids. This Project was advertised in the San Bernardino County Sun newspaper on August 4, 2026, and released on the County electronic procurement network (ePro) on August 4, 2026. Notice inviting bids was also provided to specified construction trade journals identified pursuant to Public Contract Code section 22036.
The following addendum was issued during the bidding phase.
Addendum No. 1, issued on August 13, 2026: Revised project plans and special provisions, updated wage determinations, and applicable construction standards and details.

The Department has reviewed the bids received and determined that they are responsive, and recommends entering into a contract with Onyx Paving Company, Inc., the responsive lowest responsible bidder. No appeal/protest letters were received.
