RECOMMENDATION(S)
Recommendation
1. Find that approval of Amendment No. 5 to Lease Agreement No. 05-217 with Yucaipa Valley Historical Society for office and exhibit space, parking area, and grounds at Mousley Museum of Yucaipa History, is an exempt project under the California Environmental Quality Act Guidelines, Section 15301 - Existing Facilities (Class 1).
2. Find that approval of Amendment No. 5 to Lease Agreement No. 05-217 with Yucaipa Valley Historical Society for office and exhibit space, parking area, and grounds at Mousley Museum of Yucaipa History is in the best interest of County residents and serves a public education purpose by meeting the social needs of County residents.
3. Approve Amendment No. 5 to Lease Agreement No. 05-217 with Yucaipa Valley Historical Society, through the Real Estate Services Department’s use of an alternative procedure in lieu of a Formal Request for Proposals, as allowed per County Policy 12-02 - Leasing Privately Owned Real Property for County Use, to:
a. Extend the term of the Lease Agreement for five years, from September 1, 2026 through August 31, 2031.
b. Approve and incorporate Exhibit “A” Museum Stewardship and Operational Standards.
c. Add one five-year option to extend the term.
d. Update standard Lease Agreement language.
e. Allow the Yucaipa Valley Historical Society’s continued occupancy of approximately 35,632 square feet of leased property located at 35308 Panorama Drive in Yucaipa (Assessor’s Parcel Number 0321-311-26-0000) at no rental revenue to the County.
4. Direct the Real Estate Services Department to file the Notice of Exemption in accordance with the California Environmental Quality Act.

FINANCIAL IMPACT
Approval of this item will not require the use of additional Discretionary General Funding (Net County Cost). While Amendment No. 5 (Amendment) to Lease Agreement No. 05-217 (Lease) does not generate revenue for the County, the Yucaipa Valley Historical Society (YVHS) provides a public benefit in lieu of rent by operating the museum, providing public access to exhibits and educational programming, and maintaining the interior portions of the facility at the Mousley Museum of Yucaipa History (MMYH) through volunteer-led programs. Ongoing County expenses for structural maintenance and utilities, including electricity, gas, water, and refuse disposal are estimated at approximately $12,200 annually, and are funded through the Utilities budget unit (7770001000). Administrative costs will be paid by San Bernardino County Museum (SBCM) (6510001000). Sufficient appropriations are included in the 2026-27 Utilities and SBCM budget and will continue to be incorporated into future recommended budgets.
BACKGROUND INFORMATION
On July 20, 1970, the Board of Supervisors (Board) accepted the donation of MMYH, located at 35308 Panorama Drive in Yucaipa, (Assessor’s Parcel Number 0321-311-26-0000) (Facility), from Louis B. and Mildred C. Mousley. As part of the donation, the County assumed responsibility for the ongoing maintenance and preservation of the Facility and its historical artifacts, geologic specimens, and anthropological materials. Since 2004, YVHS, in coordination with the County-initiated volunteer program and the Mousley Museum Stewardship Program (Program), has supported the maintenance of the premises and exhibits under the direction of curatorial staff at SBCM.
On April 5, 2005 (Item No. 41), the Board approved the five-year Lease, from April 6, 2005 through April 5, 2010, with one five-year option to extend the term of the Lease for 5,100 square feet of office space and exhibit space, 7,362 square feet of parking area, and 23,170 square feet of grounds for a total of 35,632 square feet of leased premises at the Facility. In the 21 years since the Lease was originally approved, the Board has approved four amendments to extend the term of the Lease through August 31, 2026, approve additional tenant improvements, add additional extension options, and update standard lease agreement language.

Approval of this item will amend the existing Lease with YVHS for the County-owned MMYH at the Facility. The Lease includes approximately 5,100 square feet of office and exhibit space, 7,362 square feet of parking, and 23,170 square feet of surrounding grounds, for a total of 35,632 square feet, with no revenue. This Amendment extends the term for an additional five years, for the period from September 1, 2026 through August 31, 2031. The Amendment also adds one five-year option to extend the term of the Lease, removes the Memorandum of Understanding, incorporates Museum Stewardship and Operational Standards (Exhibit “A”) which establishes operational standards and stewardship responsibilities applicable to the use and operation of the Mousley Museum of Yucaipa History by YVHS, and updates standard lease agreement language. All other terms and conditions such as maintenance and utilities included in the Lease remain unchanged.
The project to approve the Amendment was reviewed pursuant to the California Environmental Quality Act (CEQA) and determined to be categorically exempt under Section 15301 - Class 1 Existing Facilities because the proposed Amendment extends an existing lease for continued operation within an existing facility with negligible or no expansion of existing use.

PROCUREMENT
California Government Code section 26227 authorizes the County to grant the use of real property to private entities for programs that serve a public purpose by meeting the public health, welfare, education and public service needs of the County and the general public. County Policy 12-02 provides that the Board may approve the use of an alternative procedure in lieu of a Formal Request for Proposals (RFP) process whenever the Board determines that compliance with the Formal RFP requirements would unreasonably interfere with the financial or programmatic needs of the County, or when the use of an alternative procedure would otherwise be in the best interest of the County.
