RECOMMENDATION(S)

Recommendation

1.                     Find that approval of Amendment No. 4 to Revenue License Agreement No. 05-324 with Omnitrans, for the non-exclusive use of rack and antenna space, located at Skyland Peak Tower in Crestline, is an exempt project under the California Environmental Quality Act Guidelines, Section 15301 - Existing Facilities (Class 1).

2.                     Find that approval of Amendment No. 4 to Revenue License Agreement No. 05-324 with Omnitrans, for the non-exclusive use of rack and antenna space located at Skyland Peak Tower in Crestline is in the public interest and will not substantially interfere with the County’s existing or future use of the property.

3.                     Approve Amendment No. 4 to Revenue License Agreement No. 05-324 with Omnitrans, for the non-exclusive use of rack and antenna space located at Skyland Peak Tower (Assessor’s Parcel Number 0338-321-18-0000) in Crestline, to:

a.                     Approve a permitted holdover period from June 1, 2025 through June 30, 2026, in the amount of $18,315.

b.                     Approve revenue for the extended term from July 1, 2026 through November 30, 2030, increasing the total contract revenue by $154,142, from $433,420 to $587,562.

c.                     Approve one five-year option to extend.

4.                     Direct the Real Estate Services Department to file the Notice of Exemption in accordance with the California Environmental Quality Act.

FINANCIAL IMPACT

Approval of this item will not require Discretionary General Funding (Net County Cost).  The total revenue to be received by the County from Amendment No. 4 (Amendment) to License Agreement No. 05-324 (License) is $154,142, which includes $18,315 from a permitted month-to-month holdover and $135,327 for the extended term, including a one-time contract administrative fee of $500.  Revenue will be deposited in the Real Estate Services Department (RESD) Rents budget (7812001000).  Payments are semi-annual and annual revenue effective July 1, 2026 is as follows:

BACKGROUND INFORMATION

The County currently leases land at Skyland Peak from the United States Department of Agriculture-Forest Service (USFS), originally approved by the Board of Supervisors (Board) on February 4, 1997 (Item No. 8), Lease Agreement No. 97-82, for the term of September 16, 1997 through December 31, 2016, and on June 8, 2021 (Item No. 71), Lease Agreement No. 21-392, for the term of June 29, 2021 through December 31, 2049.  Pursuant to the terms of Lease Agreement No. 21-392, the County is authorized to sub-license space at the site to third parties. 

 

On May 3, 2005 (Item No. 82), the Board approved the five-year License with Omnitrans for rack and antenna tower space.  In the 20 years since the License was originally approved, the Board has approved three amendments, adjusting terms and adding additional renewal options.  All other terms remain unchanged:

Since the prior License term expired, RESD has continued discussions with Omnitrans to extend the License through the use of an available five-year option to extend the term from July 1, 2026 to November 30, 2030.  Omnitrans requested an expiration date of November 30, 2030 due to budgetary reasons.  Due to timing associated with negotiations and administrative processing, the License entered a permitted month-to-month holdover period beginning June 1, 2025 through June 30, 2026. 

 

The recommended action will approve the Amendment with Omnitrans for the continued use of rack and antenna space, which includes antenna space and a data circuit, within the County-owned equipment shelter and antenna, located at Skyland Peak Tower (Assessor’s Parcel Number 0338-321-18-0000) in Crestline (Premises).  The term of the recommended Amendment would commence on July 1, 2026 through November 30, 2030, with one five-year option to extend.  All other terms remain unchanged.

 

The project to approve this Amendment with Omnitrans was reviewed pursuant to the California Environmental Quality Act (CEQA) and determined to be categorically exempt under Section 15301 - Class 1 Existing Facilities because approval of an amendment for existing facilities is an exempt activity under CEQA.  There is no possibility that the License of the subject property will have a significant effect on the environment; therefore, the activity is exempt from the provisions of CEQA.

PROCUREMENT

The County can grant the license to Omnitrans, a public agency, upon a finding by the Board that the conveyance is in the public interest and that the interest in land conveyed will not substantially conflict or interfere with the use of the property by the County, in accordance with Government Code Section 25526.6.
