RECOMMENDATIONS
Recommendation
1. Adopt the Initial Study/Mitigated Negative Declaration for construction of the Arrowhead Regional Medical Center Parking Structure Project.
2. Adopt the Mitigation Monitoring and Reporting Program for the Arrowhead Regional Medical Center Parking Structure Project.
3. Approve the Arrowhead Regional Medical Center Parking Structure Project, as defined in the Initial Study/Mitigated Negative Declaration.
4. Approve Addendum No. 1, dated September 22, 2025, to the Request for Qualification for the Arrowhead Regional Medical Center Parking Structure Project, which provided responses to prospective proposers’ Requests for Information.
5. Approve Addendum No. 1, dated March 25, 2026, to the Request for Proposals for the Arrowhead Regional Medical Center Parking Structure Project, which provided responses to Pre-Qualified Proposers’ Requests for Information.
6. Award a Design-Build Services Agreement to Bomel Construction Co., Inc., in the amount of $45,860,723, as the design-builder for the Arrowhead Regional Medical Center Parking Structure Project.
7. Authorize the Director of the Project and Facilities Management Department to approve any necessary changes or additions in the work being performed under the Design-Build Services Agreement, for a total not to exceed $210,000, pursuant to Public Contract Code section 20142.
8. Authorize the Director of the Project and Facilities Management Department to accept the work when 100% complete and execute and file the Notice of Completion.
9. Direct the Project and Facilities Management Department to file and post the Notice of Determination in accordance with the California Environmental Quality Act.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost).
The proposed Design-Build Services Agreement with Bomel Construction Co., Inc. (Bomel) in the amount of $45,980,723, will be funded through the Arrowhead Regional Medical Center (ARMC) Parking Structure Project (Project) (WBSE 10.10.1924), which has a total approved budget of $52,510,997. The Project is funded through a combination of ARMC Enterprise Funds, Master Settlement Agreement, and Health 1991 Realignment revenues.
ARMC Enterprise Funds are funded by State Medi Cal and Federal Medicare reimbursements, private insurance payments, and other departmental revenues. Future funding sources may be impacted by legislative changes related to the repeal, replacement, or modification of the Affordable Care Act. The Project was approved by the Board of Supervisors (Board) on June 10, 2025 (Item No. 136), as part of the 2025-26 Capital Improvement Program (CIP) budget. BACKGROUND INFORMATION
The Project, located at 400 North Pepper Avenue in Colton, will construct a multi-level parking structure to provide a minimum of 1,600 new parking stalls to support the operational expansion of the ARMC campus. The scope of work includes structural construction, elevator towers, stairwells, lighting, security systems, a 175 kilowatt (KW) photovoltaic canopy, parking car count system, temporary parking during construction and associated infrastructure and site improvements. The Project aligns with the Board approved 2025-26 CIP as Project No. 26-003.
An Initial Study/Mitigated Negative Declaration (IS/MND) was prepared for the Project and completed in compliance with the California Environmental Quality Act (CEQA). The Mitigation Monitoring and Reporting Program (MMRP) identifies each mitigation measure included in the IS/MND and establishes a framework to ensure that such measures are properly implemented and enforced. The MMRP outlines the timing of implementation, assigns responsibility to appropriate parties, and specifies the procedures for monitoring and verifying compliance throughout Project implementation.
A Notice of Availability/Notice of Intent (NOA/NOI) to adopt the IS/MND was advertised on the Project and Facilities Management Department (PFMD) website and distributed to initiate a 20-day public comment period, which concluded on September 21, 2025. The IS/MND was also circulated through the State Clearinghouse on January 13, 2026 (State Clearinghouse No. 2026010330). No comment letters were received within the public comment period.
PFMD recommends adoption of the IS/MND and filing of the Notice of Determination in accordance with the CEQA Guidelines. By adopting the IS/MND pursuant to CEQA, the Board, in reliance on the IS/MND, is finding the Project will not have a significant effect on the environment after implementation of the mitigation measures identified in the IS/MND.
This item also seeks approval by the Board to award the Design-Build Services Agreement to Bomel as the proposer that provided the best value to the County.
PROCUREMENT
On August 19, 2025 (Item No. 40) the Board authorized PFMD to utilize the Design-Build project delivery method pursuant to Public Contract Code section 22160 et seq. and in accordance with County Policy 11-16, including all necessary steps up to award of a contract.
PFMD utilized the Design-Build method and released the Request for Qualifications (RFQ) to the public on August 22, 2025. The RFQ aided in identifying qualified Design-Build Entities (DBEs) based primarily on their qualifications and relevant experience.
On September 22, 2025, PFMD issued Addendum No. 1 to the RFQ, which provided clarifications to prospective proposers’ questions and requests for information.
On September 30, 2025, PFMD received a total of six submittals in response to the RFQ from the following firms:

An evaluation committee, consisting of representatives from PFMD and ARMC, conducted an evaluation to select the top three DBEs using predefined criteria pursuant to the RFQ and the procedures for qualifications-based selection in Government Code section 22185 et. seq.

On November 19, 2025, the Design-Build Request for Proposal (RFP) was released to the three pre-qualified DBEs, following approval by the Director of PFMD, pursuant to County Policy 11-16. The RFP included Project requirements, expectations, and responses to requests for information, enabling the proposers to submit final proposals.
On December 16, 2025, final RFP proposals were received from the three pre-qualified DBEs and the Selection Committee evaluated the proposals. Following receipt of proposals, a protest was submitted challenging the compliance with the RFP requirements and the integrity of the evaluation process. The protest alleged that certain mandatory requirements, including prescribed parking stall dimensions, were not consistently enforced and that the evaluation criteria and scoring methodology applied during proposal review were not aligned with those outlined in the RFP. The review also identified inconsistencies between the published evaluation criteria and the evaluation score sheets, as well as irregularities in the application of cost scoring and presentation scoring. Based on these findings, the Purchasing Department determined that material defects existed in the procurement process that affected the validity of the evaluation results and recommended cancellation and reissuance of the solicitation with corrective actions to ensure consistency, compliance, and fairness.
Following receipt of a protest and review of the procurement process. All proposers were notified on February 9, 2026 that the RFP was cancelled and that the County intended to reissue the solicitation.
The RFP was reissued on March 4, 2026 to the three-pre-qualified DBEs. On March 25, 2026, PFMD issued Addendum No. 1 to the reissued RFP, which provided clarifications to proposers’ questions and requests for information.
Proposals for the reissued RFP were received from the three pre-qualified DBEs on March 31, 2026. A Selection Committee consisting of representatives from PFMD, ARMC, DPW and the County of Riverside, evaluated the proposals and selected Bomel.
On June 3, 2026, the notice of award and letters of regret were sent electronically and via the United States Postal Service to the three prequalified DBEs. The RFP required that any appeal be filed within ten working days of receipt of the notification. On June 12, 2026, an appeal was received from Swinerton Builders. The Purchasing Department, in coordination with PFMD and County Counsel reviewed the protest, proposal documents, evaluation records, and procurement requirements and determined that the procurement process was conducted in accordance with the requirements of the RFP and applicable law. On June 16, 2026, a letter was sent to Swinerton Builders notifying them that their protest was denied.
PFMD recommends the Board award a Design-Build Agreement to Bomel in the amount of $45,860,723, which includes Bomel’s proposal pricing for the base proposal and the exterior architectural skin and graphics, photovoltaic canopy at top deck (175 KW), temporary parking lot and parking car count system.
