FINANCIAL IMPACT

Approval of this item will not require Discretionary General Funding (Net County Cost).  Amendment No. 1 (Amendment) to License Agreement No. 19-416 (License) does not include a license fee.  Minimal utility and administrative costs will be incurred by County Library (Library) Cost Center (6402182600).  Family Service Association (FSA) will provide janitorial services to the licensed space after each use.

BACKGROUND INFORMATION

FSA is a private, not for profit, human service organization that has been serving the needs of individuals, families and communities since 1953.  FSA provides meals to approximately 3,500 seniors daily throughout Riverside and San Bernardino Counties through the Meals on Wheels program.  On June 25, 2019 (Item No.46), the Board of Supervisors (Board) approved a contract with FSA to be the Senior Nutrition Services provider for the elderly nutrition program services and the non-exclusive use of 2,500 square feet of kitchen space and two multi-purpose rooms within the County-owned Mentone Senior Center and Library located at 1331 Opal Avenue in Mentone (Premises), for the period of July 1, 2019 through June 30, 2024.

During the permitted 24-month holdover period, the County evaluated Library’s ongoing operational requirements, community service needs, funding sources, budgetary considerations, and responsibilities for the maintenance and operation of the County-owned facility.  Following completion of those evaluations and confirmation of the continued need for the licensed use of the Premises, Library requested the Real Estate Services Department (RESD) to negotiate the License extension with FSA for the non-exclusive use of the Premises.

The recommended action will extend the License for an additional one year, from July 1, 2026 through June 30, 2027, with three one-year automatic extensions, unless earlier terminated by written notice by either party.  The License allows FSA to continue the non-exclusive use of the Premises every Tuesday from approximately 7:30 a.m. to 10:30 a.m., at no cost, for the preparation and service of meals to the senior community.

Upon expiration of the one-year License with FSA on June 30, 2027, the License will automatically renew up to three successive one-year periods unless earlier terminated by either party, with 30-days’ written notice.  The Director of RESD has the authority to give FSA notice of termination pursuant to the original License.

This project was reviewed pursuant to the California Environmental Quality Act (CEQA) and determined to be exempt from future environmental review in accordance with a Class 1 Exemption pursuant to Section 15301 of the CEQA Guidelines.
