RECOMMENDATION(S)

Recommendation

1.                     Approve Amendment No. 23 to Revenue Contract No. 02-1006 with California Speedway Corporation, to update hourly rates and extend the term, for the provision of supplemental law enforcement services on a fee-for-service basis, from July 1, 2023 through June 30, 2024.

2.                     Approve Amendment No. 11 to Revenue Contract No. 14-110 with Live Nation Worldwide, Inc., to update hourly rates and extend the term, for the provision of supplemental law enforcement services on a fee-for-service basis, for events held at various County locations, from July 1, 2023 through June 30, 2024.

FINANCIAL IMPACT

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The actual revenue received under these contracts is contingent upon the level of service provided. The new hourly service rates for 2023-24, reflected in Schedule A of the recommended contract amendments include an increase of 5.93% from the prior fiscal year, which is needed for the full recovery of both direct and indirect costs associated with providing services under these contracts. The Sheriff/Coroner/Public Administrator’s (Department) 2023-24 recommended budget includes sufficient appropriation and revenue for public gathering events.

 

BACKGROUND INFORMATION

The Department has contracts with California Speedway Corporation (Speedway) and Live Nation Worldwide, Inc. (Live Nation) to provide supplemental law enforcement services for their respective events. The services provided are performed and priced on an overtime basis and do not impact the Department’s regular patrol functions. The contracts are amended annually to update the hourly service rates. The overtime rates per safety position include indirect overhead costs, which recover the cost of support staff providing services to the Speedway and Live Nation.

 

On June 28, 2022 (Item No. 94), the Board of Supervisors (Board) approved Amendments No. 22 and No. 10 for the contracts with Speedway and Live Nation, respectively, to adjust the hourly rates for the period of July 1, 2022 through June 30, 2023. In a similar manner, prior amendments to these contracts updated the hourly rates for the corresponding fiscal years. The proposed contract amendments will amend the hourly rates and extend the terms from July 1, 2023 through June 30, 2024. Both contracts can be terminated by either party upon 90 days’ advance written notice.
