Recommendation
1. Acting as the governing body of the San Bernardino County Flood Control District, approve Amendment No. 1 to Memorandum of Understanding No. 22-146 with the San Bernardino County Department of Agriculture / Weights & Measures, for vegetation management services, in a not-to-exceed annual amount of $1,250,000, increasing the total amount by $6,250,000, from $5,000,000 to a new cumulative total of $11,250,000, and extending the term for an additional five years, for a total contract period of July 1, 2021 through June 30, 2031, with no changes to all other terms.
2. FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The San Bernardino County Flood Control District (District) is funded by property tax revenue, fee revenue, and other local, state, and federal funding. The District will use property tax revenue to fund these vegetation management services. Sufficient appropriation and revenue have been included in both the Department of Agriculture/Weights & Measures (Department) and District 2026-27 budgets and will be included in future recommended budgets.
BACKGROUND INFORMATION
District facilities provide flood protection to properties throughout the County. Vegetation growth in the channels must be kept to a minimum by vegetation management and removal to maintain maximum capacity, which allows for the maximum flood protection possible. Vegetation management within the channels also assists with fire protection. The Department has had a long-standing relationship providing vegetation management services to the District since the 1970’s and has the experience and resources to continue to provide this service for the District.
On June 28, 2016 (Item No. 110), the Board approved Agreement No. 16-493 to formalize the vegetation management services provided by the Department to the District for the period of July 1, 2016, through June 30, 2021.
On March 1, 2022 (Item No. 71), the Board approved MOU No. 22-146 to provide work performed by the Department for vegetation management and annual herbicide application training for backpack systems for the District staff, for a period of five years, for a total amount not to exceed $1,000,000 per fiscal year, $5,000,000 for the term of the MOU.
Approval of Amendment No. 1 to the MOU will increase the contract total by $6,250,000, from $5,000,000 to a total new cumulative amount of $11,250,000, extend the term for an additional five years, for a total contract term of July 1, 2021, through June 30, 2031. This increase in contract total is needed due to the increasing costs of vegetation management supplies. All other terms remain the same.
The MOU may be terminated earlier by either party upon 30 days’ advance written notice to the other party.
