RECOMMENDATION(S)
Recommendation
1. Acting as the governing body of County Service Area 70, Zone D-1:
a. Find that approval of License Agreement with Department of Public Works - Transportation Division, for use of approximately 0.33 acres of County Service Area 70, Zone D-1-owned land, is an exempt project under the California Environmental Quality Act Guidelines, Section 15301 - Existing Facilities (Class 1).
b. Approve License Agreement with the Department of Public Works - Transportation Division, for the non-exclusive use of approximately 0.33 acres of County Service Area 70, Zone D-1-owned land (Assessor’s Parcel Number 0330-011-46-0000) in Lake Arrowhead, for stockpiling road materials, for a 10-year term from September 1, 2026 through August 31, 2036, which includes three five-year automatic options to renew.
c. Approve the termination of Contract No. 17-461.
d. Direct the Real Estate Services Department to file the Notice of Exemption in accordance with the California Environmental Quality Act.
2. Acting as the governing body of San Bernardino County:
a. Approve the License Agreement with the County Service Area 70, Zone D-1 for the non-exclusive use of approximately 0.33 acres of County Service Area 70, Zone D-1-owned land (Assessor’s Parcel Number 0330-011-46-0000) in Lake Arrowhead, for stockpiling road materials, for a 10-year term from September 1, 2026 through August 31, 2036, which includes three five-year automatic options to renew.
b. Approve the termination of Contract No. 17-461.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). There will be no license fees received by County Service Area 70, Zone D-1 (CSA 70) during the 10-year License Agreement (License) term from September 1, 2026 through August 31, 2036. Expenses associated with administrative costs, the Notice of Exemption and California Environmental Quality Act (CEQA) filing fees will be associated with CSA 70 (6650002000). Adequate appropriation has been included in the CSA 70 2026-27 recommended budget.
BACKGROUND INFORMATION
On January 10, 2012 (Item No. 55), the Board of Supervisors (Board) approved a two-year, six month License Agreement No. 12-30 with CSA 70-D-1, for use of CSA 70-D-1 land by the Department of Public Works - Transportation Division (DPW-T), for stockpiling road materials from the date of execution (January 10, 2012) through June 30, 2014, at no cost
On June 24, 2014 (Item No. 107), the Board approved new three-year License Agreement No. 14-629 from July 1, 2014 through June 30, 2017, for continued road maintenance operations provided by DPW-T, at no cost.
On May 23, 2017 (Item No. 151), the Board approved new five-year License Agreement No. 17-461 from July 1, 2017 through June 30, 2022, for continued road maintenance operations provided by DPW-T, at no cost.
Approval of this action will provide a no-fee 10-year License for the continued use by the DPW-T of approximately 0.33 acres of CSA 70 land, a portion of Assessor’s Parcel Number (APN) 0330-011-46-0000, to stockpile materials for road maintenance, which terminates and replaces the current License Agreement No. 17-461.
Following the expiration of License Agreement No. 17-461 on June 30, 2022, DPW-T remained in possession of the premises on a permitted month-to-month holdover basis under the terms of that agreement from July 1, 2022 through August 31, 2026, which allowed uninterrupted road maintenance operations under this no-fee agreement between two public entities while the replacement agreement was prepared. All parties agreed that entering into a new long-term License Agreement was in the best interest of both parties to provide operational continuity.
The project to approve the License was reviewed pursuant to CEQA and determined to be categorically exempt under Section 15301 - Class 1 Existing Facilities because the proposed License continues an existing use of previously disturbed land with negligible or no expansion of use. Accordingly, no further action is required under CEQA.
