RECOMMENDATION(S)
Recommendation
Acting as the governing body of County Service Area 70, R-5 (Sugarloaf):
1. Find that the County Service Area 70, R-5 (Sugarloaf) Road Chip Seal Project located in the Big Bear area is exempt under the California Environmental Quality Act, Title 14 of the California Code of Regulations Section 15301(c), Class 1, Existing Facilities.
2. Approve the County Service Area 70, R-5 (Sugarloaf) Road Chip Seal Project as defined in the Notice of Exemption.
3. Approve the plans and specifications for the County Service Area 70, R-5 (Sugarloaf) Road Chip Seal Project
4. Authorize the Director of the Department of Public Works to advertise the County Service Area 70, R-5 (Sugarloaf) Road Chip Seal Project for formal bids.
5. Direct the Clerk of the Board of Supervisors to file and post the Notice of Exemption.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The County Service Area 70, R-5 (Sugarloaf) Road Chip Seal Project (Project) is being funded entirely by County Service Area 70 R-5 (CSA 70 R-5). Sufficient appropriation for the Project is included in CSA 70 R-5’s 2023-24 budget and will be included in future recommended budgets as needed.
BACKGROUND INFORMATION
CSA 70 R-5 was formed and approved by the Board of Supervisors (Board) on March 5, 1980 (Item No. 77) to provide road maintenance services on approximately 21 miles of road in the Sugarloaf/Big Bear area. On behalf of CSA 70 R-5, the roads are maintained and managed by the Department of Public Works - Special Districts (Department). Due to normal seasonal degradation and snow plowing damage that occurs to pavement in the winter, the roads require periodic maintenance and rehabilitation. The Department identifies and prioritizes certain roads per year for rehabilitation dependent on damage or maintenance needs to stay within annual budgetary amounts.
The Project consists of chip and fog sealing of approximately 21miles of existing asphalt road surfaces to include road surface preparation and cleaning, application of asphaltic emulsion with 5/16” rock chips and fog seal. Chip and fog sealing of the road surface dramatically increases the longevity of the road.
Department staff reviewed the Project and determined that a categorical exemption in accordance with the California Environmental Quality Act (CEQA) Guidelines, Section 15301(c), Class 1, Existing Facilities is appropriate. The Class 1 exemption allows for operation, repair, and maintenance involving negligible or no expansion of use beyond that existing at the time of the lead agency's determination, but not limited to existing highways and streets. When the Board considers the environmental finding, the filing and posting of a Notice of Exemption is recommended.
In addition to the CEQA finding, this item seeks Board approval of the Project’s plans and specifications and authorization for the Director of the Department to advertise the Project for bids.
PROCUREMENT
The Project will be advertised in accordance with Section 22037 of the California Public Contract code. The Department anticipates returning to the Board in October 2023 with a recommendation for award of the construction contract.
